JOBS Disqualifications
Applying a Disqualification • Once you have gone through the re-engagement process and no good cause has been determined, disqualification is applied the following month allowing for timely notice. • Continue to attempt contact to re -engage participant.
Computer Actions • The following are to be completed: • update the re-engagement (RE) step, • place plan in hold (HLD) status with reason active disqualification, • send support service closure notice if applicable, • Complete TRACS re-engagement tab or TRACS Reengagement Narrative, and • add computer coding applying the disqualification.
Example • Rajid was scheduled for a virtual reengagement on 11/12 and did not attend; • child risk review completed, no concerns’ • no good cause found, and • home visit not conducted due to safety/health concerns with current pandemic. • Family coach completes TRACS Reengagement Narrative, updates PDP and codes case on 11/13 applying the DQ for 12/1.
Two-week Cooperation • The two-week cooperation period begins the day the participant connects with the department and requests to engage. • Family coach and participant then mutually agree upon a plan.
Example Continued • Rajid sends a text message on Friday 12/4 to his family coach requesting to engage in the program. The family coach responds asking Rajid if he is available for a phone appointment on Monday. Rajid states yes and a phone JOBS appointment is scheduled for Monday 12/7. • Rajid attends the appointment and discusses his goals with his family coach, they mutually agree on a plan to achieve those goals.
Lifting a Disqualification • Disqualifications are lifted and benefits are supplemented effective the date: • the two-week cooperation period is completed, • good cause is determined, or • the participant becomes JOBS volunteer or exempt.
Example Continued • Rajid turned in attendance for the week of 12/7. The family coach reaches out to Rajid on 12/17 to check in, Rajid states he is doing well and has been attending his meetings consistently. • Family coach lifts the disqualification and supplements benefits effective 12/17.
Rolling DQ • If the participant does not engage and complete a twoweek cooperation period, the disqualification will roll, and monthly notice will auto send. • During DQ 3 and prior to moving to DQ 4, the reengagement process must be completed again.
• During last SOS audits errors were identified regarding when disqualifications were lifted, and benefits supplemented. • Protocols have been updated. • Quick Reference Guide (QRG) is coming soon.
Child Support Sanctions
Applying a Sanction • Once a sanction is requested by the Division of Child Support (DCS) and no good cause has been determined by DHS, a sanction is applied the following month allowing for timely notice. • Continue to assist the participant with resolving DCS’ request, if possible.
Computer Actions • The following is to be completed: • add computer coding applying the sanction, and • narrate. • Reminder: unlike DQ’s, new instances of non-cooperation with DCS always starts at CS 1. • If it is not a new instance the CS level would continue to progress.
Example • Family coach received an email from DCS on 11/19 requesting to sanction Marisa’s case as participant has not returned a Declaration in Support of Establishing Parentage (paternity affidavit) MSC 0112 to DCS. • Family coach attempts to reach out to Marisa, the phone number on file is no longer in service and no email address has been provided. The family coach sends a pending notice.
Example of Pending Notice Language • The Division of Child Support has notified ODHS that you have not returned the Declaration in Support of Establishing Parentage to your DCS. • Please contact your ODHS worker to discuss what is getting in the way and how ODHS can help with this process.
Example Continued • Marisa did not respond to the pending notice, so the family coach takes action on 12/15 to code a CS 1 on CMS effective 1/1.
Lifting a Sanction • Sanctions are lifted and benefits are supplemented effective the date the participant cooperates with DCS by supplying the requested information or good cause is determined.
Example Continued • Marisa reaches out to her family coach on 1/10 and reports she has just submitted the paternity affidavit to DCS. • The family coach verifies with DCS that they have received the paternity affidavit and confirms the sanction can be lifted. • The family coach lifts the sanction and supplements benefits effective 1/10.
Good cause for failure to cooperate with child support exists when any of the following are true: • Cooperation is reasonably anticipated to result in emotional or physical harm to the participant or to other caretaker relatives of the child(ren) involved. • One of the following circumstances exists and ODHS believes continuing efforts to obtain support would be detrimental to the child(ren): • The child was conceived due to incest or rape. • Legal proceedings for adoption are under way before a court. • A public or licensed private social agency is helping the parent resolve the issue of whether to release the child for adoption. This good cause reason is limited to three months.
Rolling CS • If the participant does not cooperation with DCS, the sanction will roll, and monthly notice will auto send. • During CS 3 and prior to moving to CS 4, the staffing process must be completed again.
