Learning for everyone… Current Legislation linked to Childcare Within the UK, all childcare settings must be fully aware of, and adhere to current legislation, guidelines, policies and procedures for safeguarding, these include: Ø Legislation (Children Act 1989) Ø The Education Act 2011, Children Act 2004) Ø Guidelines (Working Together to Safeguard Children (2018) Ø What to do if you’re worried that a child is being abused (2015) Ø Keeping Children Safe in Education (2018) Ø Safeguarding Disabled Children (2009) Ø Setting’s own policies and procedures, e. g. safeguarding and protecting, reporting and recording, e-safety, bullying and cyberbullying

Learning for everyone… Current Legislation linked to ‘Safeguarding’ Legislation (Children Act 1989)-(The Childcare Act 2006) Ø The Children Act 1989 places a duty on local authorities to promote and safeguard the welfare of children in need in their area. (b) so far as is consistent with that duty, to promote the upbringing of such children by their families. Ø The Childcare Act 2006 sets out the following legal duties. Ø Local authorities are required to ensure sufficient childcare. Ø Local authorities are required to provide information to parents and families. Ø Agencies are required to work together and integrate services. Ø The Act introduces the education and care framework (EYFS). Ø The Act reforms regulation and inspection with the introduction the Ofsted registers.

This covers: Ø maintenance of buildings. Ø cleanliness of the general environment. Ø safe use of equipment. Ø good working practices. Ø a written statement of safety policy. Ø COSHH Regulations 1994 - Control of Substances Hazardous to Health Ø The establishment must assess the risks from substances hazardous to health and take appropriate control measures. Ø RIDDOR 1995 - Reporting of Injuries, Diseases and Dangerous Occurrences Regulations

The behaviour is repeated, or has the potential to be repeated, over time. Both children who are bullied and who bully others may have serious, lasting problems.
