Dive Report Pennsylvania States with Staffing Laws • 14 states currently addressed nurse staffing in hospitals in law / regulations: CA, CT, IL, MA, MN, NV, NJ, NY, OH, OR, RI, TX, VT, and WA. • CA is the only state that stipulates in law and regulations a required minimum nurse to patient ratios to be maintained at all times by unit. MA passed a law specific to ICU requiring a 1: 1 or 1: 2 nurse to patient ratio depending on stability of the patient. • 7 states require hospitals to have staffing committees responsible for plans (nursedriven ratios) and staffing policy – CT, IL, NV, OH, OR, TX, WA. • 5 states require some form of disclosure and or public reporting – IL, NJ, NY, RI, VT
OHA Advocacy Update Board of Nursing Issue: “whether under Section 4723. 43, ORC a CNP not nationally certified in acute care may engage in acute care practice, based on clinical experience obtained post-graduate through the course of employment/workplace training”. • OHA commented on April 19, 2017 to inform the AG’s analysis • OHA submits that Ohio law permits CNPs who have acquired post-graduate clinical experience to engage in acute care practice • Ohio Board of Nursing’s APRN Advisory Committee formed • Make recommendations to the BON: • Continue the APRN Consensus Model • Asking to provide clarity - How is acute care defined? • FNPs do have a role in the hospital • Requesting to add a FNP to the committee • Next APRN Advisory meeting - Oct 1, 2018
