July 2007 doc. : IEEE 802. 18 -07 -0064 -00 -0000 Background • FCC summary of action taken and further notice of rulemaking in the proceeding In the Matter of Modification of Parts 2 and 15 of the Commission’s Rules for unlicensed devices and equipment approval: – – – Specifically, we dismiss a petition for reconsideration filed by Warren C. Havens and Telesaurus Holdings GB LLC (“Havens”) requesting that the Commission suspend the rule changes adopted for unlicensed devices in the 902 -928 MHz (915 MHz) band until such time as we complete a formal inquiry with regard to the potential effect of such changes to Location and Monitoring Service (LMS) licensees in the band. We also dismiss a petition for reconsideration filed by Cellnet Technology (“Cellnet”) requesting that the Commission adopt spectrum sharing requirements in the unlicensed bands, e. g. , a “spectrum etiquette, ” particularly in the 915 MHz band. We are, however, seeking comment on its recommendations for a spectrum etiquette in a Further Notice of Proposed Rule Making (Further NPRM) in this proceeding. Specifically, the Further NPRM seeks comment on a specific spectrum etiquette for unlicensed transmitters that operate under Sections 15. 247 and 15. 249 of the rules in the 915 MHz band. July 2007 doc. : IEEE 802. 18 -07 -0064 -00 -0000 802. 18 Action Plan • 802. 18 will take up formal consideration of comments to the FCC reqarding this FNPRM at the September 2007 Interim Meeting. • 802. 18 is soliciting the views of affected wireless groups regarding proposed changes in the ISM band rules relating to spectrum etiquette. • 802. 18 plans to submit formal Comments to the FCC after the September 2007 interim. • 802. 18 plans to submit Reply Comments to the FCC, if necessary, after reviewing the Comments submitted to this proceeding.
