Government Accounting Office (GAO), at the request of several members of congress, has found a potential “conflict of interest” in the (WYO) insurance companies administering hurricane claims and segregating the damages. The nature of this responsibility requires that the adjuster take into account causation in determining the loss and applying the damages to the Wind or Flood claim. This effectively puts the companies and its’ adjusters in the drivers seat as to loss ratio and costs to the company. NFIP claims that it does not have the authority to require submission of the claim data from the wind company and, therefore, can not guard against this potential self dealing. Source www. gao. gov

When an adjuster for the (WYO) member company sets the flood payments based on the description of direct physical damage too high in a structure, it is likely that following reports will duplicate the mistaken premise. This mistake will perpetuate the problem especially when the Flood policy begins to pay for items that very often are damaged by Wind in a hurricane. [Trees, Roof Framing, Windows, Soffit, Fascia and Gutter System, Siding] The causation when flood has blown out supporting walls or other elements of the foundation can become very difficult to determine and can greatly affect the outcome of a file and the ability of the owner to rebuild.

Bill 920 under the Multiple Perils Act of 2007, as well as by Congressman Gene Taylor of Mississippi. This act has been opposed by the insurance industry who say it could cause as much as $100 to $200 billion annually in losses - Flood coverage would end up being a huge issue for tax payers. Insurance industry lobbyist argue that while insurance has doubled since Hurricane Katrina that policies are typically available in many cases through JUA programs administered by various states, i. e. , Citizens or NC JUA. Some in government look at this as an economic development need citing that many projects are not moving forward as result of high insurance costs.
