ARISTÓTELES: Formas de gobierno “ Ya que constitución y gobierno significan lo mismo y el órgano de gobierno es el poder soberano de la ciudad, es necesario que el poder soberano sea ejercido por una persona o unos pocos o la mayoría. Cuando el uno, pocos o la mayoría ejercen el poder en vista del interés general, entonces forzosamente esas constituciones serán rectas, mientras que serán desviaciones los que atienden al interés particular de uno, de pocos o de la mayoría (…) Tenemos la costumbre de llamar monarquía al gobierno unipersonal que atiende al interés general, y aristocracia al gobierno de pocos (…) cuando se propone el bien común; cuando es el mayor número el que gobierna atendiendo el interés general recibe el nombre común a todas las constituciones politia (…) Las degeneraciones de las mencionadas formas de gobierno son: tiranía de la monarquía, la oligarquía de la aristocracia, y la democracia de la politia. ARISTÓTELES : Politia: “ En general la politia es una mezcla de oligarquía y democracia; y comúnmente se suelen llamar politias los gobiernos que tienden más bien a la democracia y aristocracia que aquellos que orientan a la oligarquía” (ideal de gobierno la mediación) Democracia y oligarquía: “Hay democracia si los libres y los pobres, siendo en número mayor, son señores del poder; hay oligarquía si lo son los ricos y los más nobles que constituyen la minoría”
BODINO : GOBIERNO y ESTADO El régimen puede ser monárquico, pero con gobierno democrático, si el príncipe permite participar a todos en las asambleas de los Estados, en las magistraturas, en los oficios, en las recompensas, sin importar la nobleza, las riquezas o el mérito. En cambio puede ser siempre monárquico, pero con gobierno aristocrático, si el príncipe no confiere poder o beneficios más que a los nobles, a los notables o a los más ricos. Igualmente una señoría aristocrática puede tener un gobierno democrático si honores y recompensas son atribuidos equitativamente entre todos los súbditos; con gobierno aristocrático si solamente tales prerrogativas se dan a los nobles o a los ricos. Esta variedad de formas de gobierno ha hecho caer en el error a algunos llevándolos a presentar formas mixtas de Estado, sin darse cuenta de que el gobierno de un Estado es una cosa muy diferente de su administración y del modo de gobernarlo” (Lib. BODINO : ESTADO DEMOCRÁTICO “ Si la mayoría de los ciudadanos es soberana pero el pueblo concede cargos honorarios, privilegios y beneficios solamente a los nobles, como se hizo en Roma hasta la ley Canuleya, se tendrá una democracia con gobierno aristocrático; si en cambio el poder está en manos de la nobleza o de los ricos, que son minoría, y los cargos, los honores y los beneficios son conferidos por los señores indiferentemente tanto a los ciudadanos pobres y humildes como a los ciudadanos ricos, sin privilegios particulares para alguien, se tendrá una aristocracia con gobierno democrático. Disolución de la Asamblea por el Ejecutivo: • PA: El jefe del gobierno puede solicitar al jefe del Estado la disolución del parlamento. • PR: El presidente no puede disolver o ejercer coacción sobre la asamblea. • CO: La asamblea se disuelve a sí misma.
