Types of Intellectual Property Patent Trademark Copyright Trade Secrets or Know How

Patents A patent is a grant of a property right from the US government to an inventor Patentee has “the right to exclude others from making, using, offering for sale, or selling the invention throughout the United States or importing the invention into the United States” The patent system encourages public disclosure of inventions thereby making it easier for improvements to be made To be patented an invention must be novel, useful and non-obvious Term of patent is 20 years from filing (plant and utility) or 14 years from date of issue (design)

Copyrights Copyright protects original works of authorship including literary, dramatic, musical, and artistic works, such as poetry, novels, movies, songs, computer software, and architecture. Copyright does not protect names, titles, coined terms, slogans or short phrases. Copyright does not protect facts, ideas, systems, or methods of operation, although it may protect the way these things are expressed. A work receives copyright protection the moment it is created and fixed in a tangible form that it is perceptible either directly or with the aid of a machine or device.

Trademarks and Service Marks A sign, design or expression to identify goods or services of a particular source Rights arise at time of actual use in commerce and continue until not used for a period of time

Trade Secrets Information that derives actual or potential economic value because it is not known or readily ascertainable by others The person/organization in possession of the secret must use reasonable efforts to keep it a secret There is no registration process for a trade secret so a secret must always be closely guarded in order to have protection

University Intellectual Property Bayh-Dole Act (1980) University of Arkansas Policy The University owns inventions made by employees using University funds or resources The University shares income from commercialization of inventions with the inventors Bio. Ventures manages the Intellectual Property on behalf of the University

Why Disclose Intellectual Property? It’s the law! The Bayh-Dole Act requires government contractors/grantees to disclose all inventions arising from research funded, in whole or in part, by the government. It’s University of Arkansas System policy! Policy 210. 1 states that the ownership of all intellectual property created by an employee of the University shall reside in the University. To benefit patients, most intellectual property will need to be commercialized

Bio. Ventures Background Founded in 1994 as the Biomedical Biotechnology Center (BBC) as part of the College of Medicine Bio. Ventures facility opened for business in 2003 BBC and its Bio. Ventures incubator program transferred to the office of VC for Research in 2007 Privatized operations into Bio. Ventures, LLC, January 1, 2017
