Procedure for granting access Access upon written request • For specific elements and time frame • Fair and reasonable conditions and price • Potential refusal within 2 months Refusal based on objective, transparent, and proportionate criteria • Technical incompatibility, safety and security • No available space (future need included) • Availability of ‘viable’ alternative infrastructure Binding dispute settlement • Can be requested by either party • Binding solution within four months • Any party can refer the case to a court 7 © Cullen International SA 2018
Coordination of civil works Network operators • The right to negotiate the coordination of civil works with telecom operators (no obligation!) Civil works fully or party funded by public money • Any reasonable and timely request by telecom operators should be met, provided no additional costs, including due to delays Exemptions • Civil works of insignificant importance • Critical national infrastructure Transparency on planned and ongoing works • When permit has been granted, is pending or will be submitted in next six months • Information on location and type of work, network elements involved, starting date and duration 8 © Cullen International SA 2018
