What is Employee Relations & HR Compliance? • Our main role is to provide guidance and counsel regarding employee matters involving the USPS, A&P, and OPS (non-faculty) classifications with appropriate Collective Bargaining Agreements, University Regulations and HR policies. We are committed in ensuring employees understand their rights and responsibilities. • We also ensure compliance with the appropriate Collective Bargaining Agreements, University Regulations and Personnel Policies. • We provide guidance to Supervisors on how to address performance concerns and work closely with departments issuing annual reviews that are below effective. Also provide guidance to employees on addressing their workplace concerns. • Oversee the Employment of Relatives Policy. • Provide guidance on lower level discipline and administer higher level discipline. 8
A little bit about me… • Joined UCF-HR in 2005 from the Harvard University School of Public Health • Received my Associate Degree from the Harvard University Extension School in 2005 • 14. 8 years in UCF Human Resources • Office Manager (1. 5 years) • Payroll Accountant (7 years) • Leave of Absence/Work Comp Coordinator (4 years) • Employee Relations & HR Compliance Specialist II (2. 5 years) • Received my Bachelor of Science Degree from UCF in 2014 • BS in Social Sciences (Minors: Psychology, Sociology, Interpersonal/Organizational Communication) • Received Professional of Human Resources (HRCI) and Certified Professional (SHRM) Certifications in 2015 9
Friendly reminders… • UCF Policy 3 -011: Background Checks (implemented March 2019) • Current employees are required to report any arrest and/or conviction which occurs during their employment with UCF to Human Resources within 48 hours of occurrence. • UCF Policy 3 -008. 2: Employment of Relatives • The form must be submitted, reviewed and approved PRIOR to extending an offer of employment, promotion or transfer of any relative. • 2019 Annual Performance Appraisals • BIG CHANGE: Copies of fully signed and completed probationary and/or annual performance appraisals, with applicable attachments, must be submitted to the email account of appraisals@ucf. edu. • Originals are maintained in the department • Multiple employees’ performance appraisals can be attached in one email but they must be in separate PDF attachments. Department of Labor FLSA Update
Notice of Proposed Rulemaking: Overtime. Update On March 7, 2019 the Department of Labor announced an updated proposed ruling 14
New Ruling Includes: • Raising the “standard salary level” from the currently enforced $455 to $684 per week (the equivalent of $35, 568 annually for a full-year worker) • For UCF, this amount is or $35, 705 per year, based on our 2088 -hour calculation • Raising the total annual compensation level for “highly compensated employees (HCEs)” from $100, 000 to $107, 432 annually; • Allowing employers to use nondiscretionary bonuses and incentive payments (including commissions) to satisfy up to 10 percent of the standard salary level, in recognition of evolving pay practices; and • No changes to the job duties test. 15
New Ruling – What does this mean to UCF? • Jobs non-exempt based on duties test are not impacted • Update exemption based on new salary threshold • Includes ‘grandfathered’ employees • Academic Advisors II – IV already switched over 16
Effective Date • Formal FLSA Nation-wide implementation date is January 1, 2020 • For UCF, this is effective December 13, 2019 • Any financial changes will be reflected in the January 3, 2020 paycheck • Employees moving from non-exempt to exempt will receive notification 17
Leave Accruals and Personal Holidays • We will be working with Payroll to determine when personal holidays need to be used • Those moving from non-exempt to exempt will now accrue leave at a higher rate 18
