HSE Update 2020 Sectors to be targeted for inspection: MANUFACTURING • Fabricated metals where inspections will focus on the control of carcinogens and asthmagens specifically associated with welding fumes and metalworking fluids. • Food and drink inspections will focus on the movement, storage and handling of heavy loads and from repetitive tasks which cause MSDs. They will also focus on the control of asthmagens arising from flour dust in bakeries • Woodworking inspections will focus on ill-health risks, particularly occupational asthma and sino-nasal cancer which can result from poor control of exposure to wood dusts HHSG Feb 2020 9

HSE Update 2020 Sectors to be targeted for inspection: (Cont’d) WASTE & RECYCLING • Inspection activity will focus specifically on the management of maintenance activities and safe isolation practices to prevent fatal and serious incidents within this industry. They will also inspect selected premises to assess how effectively the health risks associated with exposure to bioaerosols are being managed. • Approximately a third of premises where intelligence received from other regulators indicates known poor performance HHSG Feb 2020 10

HSE Update 2020 Sectors to be targeted for inspection: (Cont’d) AGRICULTURE • Inspections will be made to 10% of those businesses invited to attend insight-led agricultural compliance events and will focus on the range of workplace risks covered in those events. • They will also inspect selected premises to assess the management of risks associated with livestock in response to persistent fatal incident rates in this area. HSE Update 2020 Sectors to be targeted for inspection: (Cont’d) CONSTRUCTION • Inspections will be made on SMEs carrying out refurbishments • They will want to embed the requirements of the Construction Design and Management Regulations 2015 (CDM) through targeted inspections of duty holders providing principal designer services • The inspections will review the prevention and control of occupational lung disease (especially asbestos and dust) and musculoskeletal disorders. HSE Update 2020 Sectors to be targeted for inspection: (Cont’d) FAIRGROUNDS • Recent incidents highlight the risk of failure or incorrect operation of some rides which can result in fatalities and multiple serious injuries. • Public safety is an inspection priority alongside the control of risks to the public both from fixed and travelling fairgrounds. • Emphasis will be on the standards of inspection and maintenance of rides and the control of risks associated with inflatables. HSE Update 2020 Other Issues Health, Safety and Brexit • In terms of duties around health and safety, the Health and Safety Executive (HSE) has recently issued clear guidance which states that duties to protect the health and safety of people affected by your work will not change with Brexit • To maintain standards The EU (Withdrawal) Act 2018 ensures that, whatever the outcome certainty remains on health and safety for duty holders across the UK. The Act corrects minor inaccuracies, such as changing ‘European Union’ to ‘United Kingdom’. HHSG Feb 2020 16

HSE Update 2020 ENVIRONMENTAL BILL 2020 • It builds on one of the largest responses to a Defra consultation on the requirements for this draft legislation. The level of public interest in the Environment Bill is clearly demonstrated through the 176, 746 responses • The bill sets out how we will create a pioneering new system of green governance, placing the 25 Year Environment Plan on a statutory footing. • Plans to improve our environment, and provisions on air quality, waste and water resource management, and restoring nature. HSE Update 2020 WHY WE NEED THE BILL • Acting as one of the key vehicles for delivering the bold vision set out in the 25 Year Environment Plan, the Environment Bill brings about urgent and meaningful action to combat the environmental and climate crisis we are facing. It sets a new and ambitious domestic framework for environmental governance and helps to deliver on the government’s commitment to be the first generation to leave our environment in a better state. • The Environment Bill helps to manage the impact of human activity on the environment, creating a more sustainable and resilient economy, and enhancing well-being and quality of life. It will engage and empower citizens, local government and businesses to deliver environmental outcomes and create a positive legacy for future generations. • The Environment Bill has been prepared through consultations with the public on numerous measures, including: environmental governance; the clean air strategy; biodiversity net gain; trees; conservation covenants; extended producer responsibility for packaging; recycling; a deposit return scheme for drinks containers and water. HSE Update 2020 ENVIRONMENTAL GOVERNANCE • A new statutory cycle of target setting, monitoring, planning and reporting will help deliver significant, long term environmental improvement and ensure government can be held to account for its actions. The Government will set new legally binding targets in four priority areas of the natural environment: air quality; waste and resource efficiency; water and nature. The Environmental Improvement Plans and legally binding targets will be reviewed on a five-yearly basis. • The Environment Bill will establish a new public body – the Office for Environmental Protection – an independent, domestic watchdog. The new body will monitor progress in improving the natural environment and will give written advice on any proposed changes to environmental law. HHSG Feb 2020 25

Failures by public authorities to implement environmental law will no longer be considered through European enforcement processes and instead the new body will engage with public authorities to reach a solution. Legal proceedings will only be taken as a last resort or in truly urgent cases. HHSG Feb 2020 26

HSE Update 2020 A NEW DIRECTION FOR RESOURCES AND WASTE MANAGEMENT • Material resources are at the heart of our economy, and we consume them in large quantities. Since 2015 the government has introduced a 5 p charge on single use carrier bags, reducing big supermarkets plastic bag sales by 90%1; introduced a ban on microbeads in rinse-off personal care products; and announced a ban on plastic straws, drinks stirrers, and plastic stemmed cotton buds in England. • The resources and waste measures in the Bill will help move the economy away from the ‘take, make, use, throw’ system to a more circular economic model where we keep resources in use for longer and extract the maximum value from them. HSE Update 2020 A NEW DIRECTION FOR RESOURCES AND WASTE MANAGEMENT • The Environment Bill helps consumers to make purchasing decisions that support the market for more sustainable products. It contains powers to introduce clear product labelling, which will enable consumers to identify products that are more durable, reparable and recyclable and will inform them on how to dispose of used products. • The Bill also takes steps to crack down on illegal waste activities, which costs the English economy around £ 600 million per year. HSE Update 2020 A NEW DIRECTION FOR RESOURCES AND WASTE MANAGEMENT • To support citizens’ efforts to recycle more, the Environment Bill stipulates a consistent set of materials that must be collected from all households and businesses, including food waste. The Bill also sets out how government will mandate weekly collections of food waste for every household, subject to consultation. • The Environment Bill also helps deliver commitments in the 2017 Litter Strategy to promote proportionate and effective enforcement against littering. HSE Update 2020 IMPROVING THE AIR WE BREATHE • The Environment Bill makes a clear commitment to set an ambitious, legally binding target for the pollutant with the most significant impact on human health, fine particulate matter. • The Bill also strengthens the ability for local authorities to address air quality issues. • The Environment Bill enables greater local action on air pollution by updating, simplifying and strengthening the local air quality management framework (LAQM). HSE Update 2020 IMPROVING THE AIR WE BREATHE • Measures are also being introduced to reduce emissions from the single largest contributor of fine particulate matter emissions – domestic solid fuel burning. The Bill creates a simpler mechanism for local authorities seeking to reduce smoke emissions within their areas. • Finally, the Bill introduces a new power to compel vehicle manufacturers to recall vehicles for environmental nonconformity or failure, in the case that a manufacturer refuses to issue a voluntary recall. It also lays the foundation for the Nature Recovery Network. • The Environment Bill introduces a mandatory requirement for biodiversity net gain in the planning system, to ensure that new developments enhance biodiversity and create new green spaces for local communities to enjoy and improvements in air quality, water flow control, outdoor recreation and physical activity. HSE Update 2020 CHEMICAL REGULATION (REACH) • The Environment Bill allows amendment to two pieces of legislation regulating the use of chemicals in the UK. The REACH (Registration, Evaluation, Authorisation and Restriction of Chemicals) Regulation regulates the manufacture, placing on the market and use of chemicals. • The Bill also gives the Devolved Administrations concurrent powers to amend the REACH Enforcement regulations. Both pieces of legislation are retained EU law under the European Union (Withdrawal) Act 2018. • It will also make it possible to keep the legislation up to date and respond to emerging needs or ambitions for the effective management of chemicals.
