Guidelines and procedures for Seclusion and Physical Restraint of All Students MADISON COUNTY SCHOOLS

�Madison County Schools acknowledges that maintaining a school environment conducive to learning requires that the environment be orderly and safe. The system recognizes that physical restraint of a student may sometimes be necessary in order to protect the student and other individuals.

�Physical restraint of a student should only be used in order to protect a

�Physical restraint of a student should only be used in order to protect a student and/or member of the school community from imminent, serious physical harm. �Physical restraint should never be used as a form of behavior management.

�Techniques for the prevention and de-escalation of inappropriate behavior should always be the first

Prohibited Uses of Restraint �Chemical restraint is the use of any medication that is used to control violent physical behavior or to restrict the student’s freedom of movement that is not prescribed treatment for a medical or psychiatric condition of the student. �Chemical restraint is prohibited.

Prohibited Uses of Restraint �Mechanical restraint is the use of any device or material attached to or adjacent to a student’s body that is intended to restrict the normal freedom of movement and which cannot be easily removed by the student. �Mechanical restraint is prohibited.

Prohibited Uses of Restraint This term does not include an adaptive or protective device recommended by a physician or therapist when used as recommended to promote normative body positioning and physical functioning, and/or to prevent self-injurious behavior. This term does not apply to seatbelts and other safety equipment when used to secure students during transportation.

Prohibited Uses of Restraint �Physical restraint is direct physical contact from an adult that prevents of significantly restricts a student’s movement. �Physical restraint is prohibited except in situations in which the student is an immediate danger to self or others and the student is not responsive to reasonably implemented and less intensive interventions, such as verbal directives and other de-escalation techniques. Physical restraint as a form of discipline or punishment is prohibited.

Seclusion is a procedure that isolates and confines the student in a separate, locked

Seclusion is a procedure that isolates and confines the student in a separate, locked area until he or she is no longer an immediate danger to himself/herself or others. Seclusion occurs in a specifically constructed or designated room or space that is physically isolated from common areas and from which the student is physically prevented from leaving. Seclusion is prohibited.

What seclusion is NOT �In-school suspension �Detention �Time-out �A student requested break in a different location in the room or in a separate room.

Time-out is a behavioral intervention in which the student is temporarily removed from the

Time-out is a behavioral intervention in which the student is temporarily removed from the learning activity. Time-out is appropriately used and is not deemed seclusion when: The non-locking setting used for time-out is appropriately lighted, ventilated and heated/cooled. The duration of the time-out is reasonable in light of the purpose of the time-out and the age of the child. However, each time-out should not exceed 45 minutes. The student is reasonably monitored by an attending adult who is in reasonable physical proximity of the student and has sight of the student while in time-out. The time-out space is free of objects that unreasonably expose the student or others to harm.

Requirements � A staff member who uses any form of seclusion or restraint, whether permitted or prohibited, must promptly report the incident to the local school principal. � If physical restraint is used with a student, a written summary of the restraint must be completed. � Parents must be notified, in writing, of the use of restraint within one school day. A copy of the written summary of restraint may be used for this notification. � A debriefing session must be held including all school personnel involved in the incident of restraint within five school days. � A copy of the written summary of restraint and documentation of the debriefing session should be submitted to the Director of Special Education.

Violation of these procedures by school system personnel may be deemed to be a failure to perform duties in a satisfactory manner and may be deemed to provide grounds for disciplinary action, including dismissal, if appropriate under the circumstances.

Faculty training in de-escalation strategies and techniques is available from the TRC upon request of the local school principal.
