UHPA Bylaws, 7 d. • To make recommendations to the Board regarding the final disposition of formal grievances where arbitration is requested; and • To review contract provisions for changes to be recommended to the Collective Bargaining Committee
UHPA Standing Rule 3. • hear the grievant’s allegation that the contract has been violated • determine whethere is sufficient cause to recommend BOD approve • Be mindful of Union’s duty of fair representation (base decision on merits of the case)
Merits of the Case. 1) It is grounded in a contractual right. 2) There is enough evidence or proof. 3) It has been properly filed in a timely manner.
Time Limits ARTICLE XXIV, GRIEVANCE PROCEDURE A grievance must be filed within twenty (20) calendar days or within forty-five (45) calendar days in the case of a class action grievance.
Limitations. • The arbitrator may not add to, subtract from, disregard, alter or modify any thing in the contract (XXIV, C 2, d 2) • Negative tenure actions are not subject to the Grievance Procedure (XII, G)
