Commonly Used Planned Giving Tool #1 Last Will and Testament • Basic estate planning tool • Protect and provide for family • Gifts to favorite charity easily made • Consider church or charity as an extra heir • Create a family endowment with Legacy Deo • Designate a specific $ amount or % of estate assets
Trivia Quiz What do these people have in common? • • • Jimi Hendrix Sonny Bono Michael Jackson • • • Pablo Picasso Howard Hughes Abraham Lincoln All of them died intestate … … without a WILL!
One More Example – Prince… • Estate value: ~$200 -300 million • No Last Will and Testament • Taxes: about 50% of estate value! • No surviving spouse, children, or parents • Five half-siblings and one full sister • Some very happy lawyers!
What Happens if YOU Die Intestate? 1. The state will decide how your property is distributed. 2. Those decisions may not be in accord with your wishes. 3. If you have minor children, the state will choose their guardians, maybe or maybe not the ones you would choose. 4. The state may distribute some of your property to recipients you might not choose, including estranged relatives. 5. If you have no living relatives, your estate assets will become the property of the state. 6. Unnecessary probate costs may dilute or drain your estate. 7. Your charitable intent will not be fulfilled.
