BACKGROUND INFORMATION ABOUT THE CASE • Clarence Gideon was accused of stealing money from a pool hall in 1961. • He did not have an attorney during his trial. • Guilty verdict-5 years in prison • Discussion: Do you see his dilemma?

WHY DIDN’T GIDEON GET AN ATTORNEY ORIGINALLY? • Gideon requested for a lawyer at his trial. • However a state of Florida judge told him criminal defendants that seemed guilty and would suffer the death sentence were given an attorney. • Discussion: How unfair is this rule?

HOW DID GIDEON WIN? • He petitioned habeas corpus-release from unjust imprisonment. • The Florida Supreme Court denied him of this. • The U. S. Supreme Court reviewed the case in 1963. • The Supreme Court, in a unanimous decision written by Justice Hugo Black, ruled that Gideon's conviction was unconstitutional because Gideon was denied a defense lawyer at trial.
