INTRODUCTION § The original constitution did not contain fundamental duties. § These were incorporated with directive principles of state policy in 1976. § Fundamental duties are not specifically contained in most of democratic constitution of world. e. g. USA, Canada, France, Germany, Australia. § Japan is only exception after India!! § On the other hand, most of socialist countries incorporate it. e. g. USSR. Swaran Singh committee § In 1976, committee setup to recommendation about the fundamental duties. § Need and necessity was felt during the operation of internal emergency. § Recommendation by committee was accepted and enacted in 1976, 42 nd amendment. § Interestingly, certain recommendations were not accepted. § They were: 1. The parliament may provide for imposition of penalty or punishment in case of non compliance of any duties by citizens. 2. No law imposing such penalty or punishment can be called in question in any court in any circumstances. 3. Duty to pay taxes. Fundamental Duties § Article 51 A enlists following duty to be abided to all citizens of India. 1. To abide by Constitution and its ideals, institution, the National flag and the National Anthem. 2. To cherish and follow the noble ideals that inspired the national struggle and freedom. 3. To uphold and protect the sovereignty, unity and integrity of India. 4. To defend the country and render national service when called upon so. 5. To promote harmony and spirit of common brotherhood amongst all people of India transcending religious, linguistic & regional diversity and to renounce practices derogatory(���� ) to the dignity of women. Contd. 6. To value and preserve the rich heritage of country’s composite culture. 7. To protect and improve natural environment including forests, lakes, rivers and wildlife and to have compassion for living creatures. 8. To develop scientific temper, humanism, and spirit of inquiry and reform. 9. To strive towards excellence in all spheres of individual & collectively activity so that nation constantly rises to higher levels endeavour and achievement. 10.
