Definition of Final Acceptance Report The legal act of „Final Acceptance“ (according to § 640 BGB and § 12 VOB/B) corresponds to the general statement that a component and/or a work meets all contractual agreements. The Final Acceptance Report regulates the transfer of ownership • It has to be distinguished from the other technical acceptance tests such as FAT, SAT, . . . • In case of FAIR Gmb. H it means a component is delivered by a supplier according by the contractually agreement and is free of any defects • The Final Acceptance Report can be provided as per contract or upon request by the supplier • The process starts with the request of the supplier to obtain the Final Acceptance Report | M. Differences between FAT, SAT and Final Acceptance Report • SAT und FAT are technical verification without legal consequence • Final Acceptance is a legal acceptance with impact on fiscal, reimbursement, transfer of risk and begin of warranty and regulates the transfer of ownership • Process owner for the final acceptance is PMO / Reporting & Processes (RTO) m. raponi@gsi. de Final Acceptance Report | M. Conditions for successfully Final Acceptance Report • After the last technical acceptance according to agreed timeline is perfomed • After production, testing and delivery of the entire contract content is fullfilled The Final Acceptance Report can be also refused by contractual reasons. - Missing Documentation - Not completed delivery - Defects (criticality to be assessed by FAIR Subprojectleader) - etc. Final Acceptance Report | M. Final Acceptance Report Process – Steps a) Provider request the Final Acceptance to FAIR 1. Provider request the Final Acceptance to Workpackage Leader 2. Workpackage Leader verifies the contractor`s fullfilment and choose one of the FA variants 3. Workpackage Leader compiles the FA form including the last SAT protocols and send it to the requester for signature 4. After receiving the signed FA form by the requester the WPL provide it to his Subprojectleader to declares acceptance 5. The signed Final Acceptance will be provided to PMO, that ensure that all parties signed according to the Release strategy 6. Afterwards PMO informs all parties including the WPL and distribute the Final Acceptance Report to the Provider and archive all documents Final Acceptance Report | M. Raponi | 26. 05. 2020 6
