Final formulation of the Sustainable Investment Regulation Art. 9. 1 An economic activity shall be considered to contribute substantially to the transition to a more circular economy and waste prevention and recycling where that activity contributes substantially to that environmental objective through any of the following means: […] (i) Minimising incineration and avoiding disposal (including landfilling) of waste, in accordance with principles of the waste hierarchy; European Federation of Waste Management and Environmental Services

Final formulation of the Sustainable Investment Regulation Art. 12: Significant harm to environmental objectives (. . ) An economic activity shall be considered as significantly harming: (d) Circular economy, including waste prevention and recycling, where that activity leads to significant inefficiencies in the use of materials and the direct or indirect use of natural resources such as non-renewable energy sources, raw materials, water and land in one or more stages of the life-cycle of products, including in terms of durability, reparability, upgradability, reusability or recyclabiity of products; or where that activity leads to a significant increase in the generation, incineration or disposal of waste, with exception of inicineration of non-recyclable hazardous waste, or where the long term disposal of waste may cause significant and long-term harm to the environment; European Federation of Waste Management and Environmental Services

Formulation of the TEG’s final report (March 2020) The final report does not include Waste to energy, yet it mentions the following (p: 208): Experts’ opinions different on whether this would be an appropriate environmentally sustainable activity offering a substantial contribution to climate mitigation. On the one hand, these were arguments against the inclusion of Wt. E. These highlighted the large portion of waste currently incinerated that could be recycled, the reliance of some individual MS on the incineration of municipal waste, and the risk that further increasing capacities risk overcapacities and could result in lock-in effects. (…). On the other hand, it was emphasized that Wt. E has a role to play even in an increasingly circular economy, as not all residual waste can be reused or recycled. (…) Therefore, the TEG has not included Wt. E, but recommends bringing this matter for further discussion and consideration to the Platform on Sustainable Finance”.
