Fair Use • Fair use is a copyright principle based on the belief that the public is entitled to freely use portions of copyrighted materials for purposes of commentary and criticism.
what about teachers? • Teachers can encounter copyright and/or fair use issues in any number of ways. This presentation will focus on videos in the classroom and what is or is not allowed according to fair use policies.
Videos for educational purposes • If a teacher wants to show a video they must adhere to the following regulations: 1. Teachers can use purchased or rented videotapes or DVDs in the classroom. 2. The material must be legitimately acquired. 3. The material must be for instructional use, not a reward. 4. Copying is OK if replacements are not available at a fair price or a viable format.
What do you think? • The next three slides will give you scenarios and you must figure out if the action of the educator is legal according to fair use guidelines. Good luck!
Scenario 1 • Hooray! Standardized testing season is over! Mr. Jones wants to reward his students for all of their hard work by showing them the latest Star Wars film that he just purchased on DVD. Can Mr. Jones do this? Why or why not? • NO. According to fair use guidelines for educational purposes, DVDs can be shown for instructional purposes, not as a reward.
Scenario 2 • Mrs. Arcement’s copy of The Century: America’s Time is nearly 20 years old and is in bad shape. She has searched the internet and various stores and cannot find a replacement for less than $500. Can she make a copy herself? Why or why not? • YES! Copying is OK if replacements are not available at a fair price or a viable format. Enjoy those videos for years to come!
Scenario 3 • Ms. Monroe has just finished discussing the Battle of Gettysburg during her Civil War unit. She would like to show the film version of Gettysburg which she has purchased. Can she show this? Why or why not? • YES! The film is for instructional use because it supplements her instruction on the Battle of Gettysburg.
Conclusion • As Teachers, we are always searching for the perfect tool to help improve our instruction. We must be cautious not to violate fair use policies and copyright laws while doing so. If you are unsure, consult this power point or any of the web sites listed on the Citation slide.
