Hz Specific standards • Robotic lawnmowers (EN 303 447) (**) • TB Approved, awaiting start of ENAP • Inductive-loop hearing aids (EN 303 348) • ENAP comments (DE, UK) being resolved • TB Approval for NV expected soon • Metal and object detection sensors in the frequency range 1 k. Hz to 148, 5 k. Hz (EN 303 454) Non-specific standard (EN 303 660) under consideration 16 © ETSI 2011. All rights reserved
M/536: Metal and object detection sensors Industrial capacitive/inductive sensors discussed in the context of the RED Guide drafting group • ETSI has started work on Harmonised Standard (EN 303 • • 17 454) on the working assumption that metal and object detection sensors are covered by RED Covers inductive & capacitive sensors (e. g. wood detection inside plaster walls) Applications include power tools, security systems (at airports) or for packaging applications All devices operate by creating emissions into free space • Commission Decision 2006/771/EC footnote (14): “The inductive device category covers …. Typical uses include … cable detection, …, proximity sensors …” © ETSI 2011. All rights reserved
M/536: Non-regulated frequencies (e. g. below 9 k. Hz) Duties of manufacturers (as discussed in RSCOM-TCAM#3 (8 October 2015)) • Article 7 of the RED requires Member States to allow the putting • • 18 into service and use of radio equipment if it complies with the Directive. Member States may introduce additional restrictions on certain grounds, including the effective and efficient use of the radio spectrum. Article 10. 2 requires manufacturers to ensure that radio equipment shall be so constructed that it can be operated in at least one Member State when placing it on the market. As the Radio Spectrum Decision (676/2002/EC) does not provide for Community harmonisation measures below 9 k. Hz, restrictions in these bands can only be introduced by individual Member States. © ETSI 2011. All rights reserved
Non-regulated frequencies (e. g. below 9 k. Hz) ETSI therefore assumes that equipment may be: • placed on the market throughout the Community unless all • Member States have introduced National restrictions preventing its use, and operated in Member States that have not introduced such National restrictions. ETSI further assumes that: • Harmonised Standards contain requirements in order to enable • • 19 compliance with essential requirements (article 3) to be presumed Harmonised Standards do not address restrictions on the use of equipment (article 7) nor the duty of a manufacturer to place on the market equipment which can be used in at least one Member State (article 10. 2) Nevertheless, Harmonised Standards should not be produced for radio equipment that is known to only use frequencies that are forbidden in all MS. © ETSI 2011. Intelligent Transport Systems EN 302 571 HS under art 3. 2 Approved for National Vote phase of ENAP Comments on technology neutrality resolved Does not favour the use of any technology Provided that the technical specifications implementing the essential requirements are respected Channel access • Different technologies should have equal probability to • • 20 access a channel. Algorithm is not known today: investigations needed Once a solution is developed and agreed upon, it is recommended to implement it in a later revision of EN 302 571 © ETSI 2016. All rights reserved

Summary of major concerns 26 Need to improve EC/ETSI process for review of Harmonised Standards for citation in the OJEU Current process requires frequent changes to ENs post adoption, which: a) Create delays in citation, with a risk that HS are not cited in time b) Create a mis-match between the versions adopted (and transposed into National standards) and versions cited in the OJEU ETSI requests that EC assess standards during Public Approval, allowing their comments to be taken into account in a timely & transparent manner © ETSI 2011. All rights reserved
If standards are not cited in time Draft standards on ENAP can be used by manufacturers as the basis of a technical file EG 203 336 (Guide to selection of technical parameters for Harmonised Standards) can be used by Notified Bodies (art 3. 2) if no public draft exists EG 203 367 (EMC for Combined Equipment) provides an agreed technical basis, and is being used as the basis for Harmonised Standards under development Can also be used by enforcement authorities as a technical basis for assessment. 27 © ETSI 2011.
