Hearing Continuance • On March 4, 2008, the Board of County Commissioners unanimously passed a motion to continue the matter until April 8, 2008. • On April 8, 2008, the Board of County Commissioners passed a motion to continue the matter until May 13, 2008, in order for the applicant and the objector to come to a resolution.

Staff Report Conditions Revised The following conditions from the staff report dated May 5, 2008 have been revised: 1. Construction activities shall be completed in accordance with the “Site Plan” submitted by Terra-Max Engineering, Inc. , dated as received January 10, 2008, and May 13, 2008 by the Environmental Protection Division (EPD). 2. The planting must be implemented in accordance with the “Planting Plan” submitted by Terra-Max Engineering, Inc. , dated as approved on May 13, 2008, by the EPD and must include wetland plants on 2 -foot centers.

Action Requested ACTION REQUESTED: Approval of the After-the-Fact Shoreline Alteration/Dredge and Fill permit, subject to the conditions listed in the staff report, with modifications as presented to Conditions #1 and #2.
