Obtaining legal status in the Czech Republic • Becoming legal in the Czech Republic as a Non-EU citizen you need to obtain a long stay visa after your short term visa expires. • The long stay visa can be issued for the following purposes: – Employment - work visa you need a work permit or a green/blue social insurance card – Business - establish a CZ company or arrange for the trade license – Family reunification - family member or a spouse is legal in CZ or is an EU citizen – Study - a document on enrolment to studies – Sport – Medical tourism – Other • A long-term visa (over 90 days) application can be filed at a Czech Embassy abroad , application fee is 2. 500 CZK (usualy), application processing deadline is 90 days. The application filing does not entitle you to be legal in the Czech Republic • Application Requirements: – Application form, passport, photos, purpose of stay document, proof of finance, medical insurance, accommodation confirmation, criminal background check – All documents submitted for any visa applications must be filed in originals, not older than 180 days, superlegalized and translated into Czech by a certified translator.
Employee card in the Czech republic • • • A long term residence permit for employment purposes is in effect for all kinds of jobs issued for max. 2 years entitles you to work for the employer at the work place, where the EC is applied, or work at your post to which has been granted approval by the Department for Asylum and Migration Policy of the Ministry of the Interior There are two types of EC: • 1) authorizes the same time of stay in the Czech Republic and employment (EC Dual) • 2) authorizes only stay in CZ (EC nondual) Who can apply • if you are a foreigner from a third world country and do not have family members of the EU, Iceland, Liechtenstein, Norway or Switzerland do not have a lodged application for temporary residence with family members of citizens of the EU, Iceland, Liechtenstein, Norway and Switzerland Where to apply for EC • the embassy in your country of origin (if you are a citizen of a State that is listed, you can also submit a request in another country where you have a long term residence permit) • Department for Asylum and Migration Policy of the Ministry of the Interior (if you are staying in the Czech Republic on the basis of a visa for a stay exceeding 90 days, or on the basis of a permanent residence permit issued for other purposes)
Necessary steps from the employer • First of all, the company has to be registered in the system as a company which employes foreigners. Evidenční list together with the excerpt of the commercial register and Hlášenka (the document announcing the job possition and announcing the intention to post it as a free job offer for employee card) has to be delivered to the Labor office. The Labor office will post it on-line (it takes between few days and 2 weeks). • After the period of 30 days, the position will be posted and the Labor office will issue the number for the employee card. So the 30 days after the posting of the position you can apply for the employee card. The process takes about 2 months.
Application requirements Requirements to apply for the employee card: 1) A passport 2) Two photos of EU size 3) The application form with the number of the position 4) The employment contract An employment contract or a letter of intent stipulating the parties' commitment to conclude an employment contract or a contract for work within the specified date which contains a provision stipulating that the foreigner's monthly wage, salary or remuneration will not be lower than the basic rate of the monthly minimum wage regardless of the extent of work; the weekly working hours in each basic employment must be at least 15 hours. 5) The accomodation confirmation signed at the notary public by the owner of the property The fee at the embasy is 500 CZK and the fee at the Immigration office is 2 500 CZK.
When can I start to work? • • • File the application Embassy has 60 – 90 days to decide Before the visa is entered, you will be asked to submit a travel medical insurance certificate valid for the period from the date of entry into the territory of the Czech Republic to the date on which you start your employment, which will be the date on which you will acquire public medical insurance in the Czech Republic. After your arrival to the Czech Republic within 3 working days visit an office of the Ministry of the Interior for the purpose of providing the biometric data After acquisition of the biometric data, a certificate confirming compliance with the conditions for issue of an employee card will be issued to you. On the date on which the Ministry of the Interior issued the certificate confirming compliance with the conditions for issue of an employee card you can start to work.
