PROBLEMS WITH EVALUATION • Inconsistent policies and practices across state • Often not done by staff with no clinical mh background or limited behavior background • Often ignore critical information
LRE VIOLATIONS Children are often not offered meaningful MH or behav services outside of segregated setting •
LIMITED “MENU” OF SERVICES/SUPPORTS MH services often limited to: Placement in “Counseling Enriched Setting” OR Counseling that is not coordinated with other services/supports

CHANGES NEEDED • Better state and district monitoring re LRE • Increase legal protections against non-emergency restraint and seclusion and dangerous types of restraint and seclusion • Better enforcement of monitoring of current state laws related to restraint and seclusion
