Examples of international human rights law in UK law even without direct or indirect incorporation. Legislation - UK Criminal Justice Act 1988, sectoral incorporation of the prohibition against torture – criminalises torture. Case law - Kennedy v the Charity Commission [2014] 2 UKSC 20 – relied on HRC General Comment 34 on freedom of expression and the expanding nature of the right. Public policy – Scottish Government’s policy of conducting CRWIAs in order to fulfil Ministerial duties under the Children and Young Person (Scotland) Act 2014.

Special Procedures - Special Rapporteurs (Poverty, Prof Philip Alston) - Working Groups (Arbitrary Detention) - Can be thematic or country specific (Human Rights in Cambodia, Prof Rhona Smith) Universal Periodic Review These also contribute to understanding where Scotland sits in terms of international human rights standards but are distinct from treaties.
