Chief Justice John Marshall Leads many court decisions which help to define the role of the Supreme Court Principle of Judicial Review- Supreme Court decides if laws made by Congress and/or acts of the President are constitutional Laws found to be unconstitutional are declared void
Mc. Culloch vs. Maryland 1818 - state of Maryland tries to tax the Second Bank of the United States James Mc. Culloch works on the Baltimore branch of the bank; refuses to pay the tax Case Questions: “Did Congress have the authority to establish the bank? ” “Did the Maryland law unconstitutionally interfere with congressional powers? ” (Case questions quoted from Oyez. com)
Court Decision- Unanimous for Mc. Culloch Congress has powers implied by the Constitution “To make all Laws which shall be necessary and proper for carrying into Execution the foregoing Powers, and all other Powers vested by this Constitution in the Government of the United States, or in any Department or Officer thereof. ” Constitution, Article 1, Section 8) “necessary”= “appropriate and legitimate” Federal government is “supreme within its sphere of action”
Gibbons v. Ogden Background Robert Fulton and Robert Livingston granted steamboat navigation monopoly in NY Aaron Ogden purchased rights from Fulton & Livingston Thomas Gibbons shipping between NY and NJ Ogden sues Gibbons
Court Decision- Unanimous for Gibbons 1824 Interstate Commerce reserved to Congress NY can’t interfere with it Therefore the monopoly was invalid
