HB 1041 – Scope of Practice Building Collaborative Care between Physicians and Pharmacists � Status ◦ Passed House, now in Senate ◦ Voted out of the Senate Consumer Protection and Professional Licensure ◦ Will be up for full vote on Senate floor soon!
HB 1041 – Scope of Practice Important Points Collaborative practice is a growing trend, already permitted in many states � Pharmacists can help physicians managing specific patient needs � ◦ Disease state management (diabetes, anticoagulation, etc) ◦ MTM services ◦ Immunizations � Voluntary agreements between a physician and a pharmacist ◦ Patient remains under the overall care of the physician ◦ Must voluntarily agree to participate � Collaborative practice improves health outcomes! � No affect on typical prescribing and dispensing ◦ Studies have shown positive results when pharmacists have been involved in disease state management, such as with diabetes, asthma, smoking cessation, etc.

HB 882 / SB 596 – Fair Audits Providing for uniform and standard practices in auditing of pharmacy claims Status: Similar bills introduced in House and Senate ◦ HB 882: passed out of the House Health & Human Services Committee and referred to the House Appropriations Committee ◦ SB 596: introduced and referred to the Senate Banking and Insurance Committee
HB 882 / SB 596 – Fair Audits Important Points PBMs and the audits they perform are NOT regulated � Thousands of dollars are reclaimed from pharmacies based on minute clerical errors � Prescribers are not penalized if they write a prescription inappropriately � ◦ Example: ◦ Physician writes the wrong strength when writing a script ◦ He crosses out the mistake, writes the correct strength, and indicated that he made a correction ◦ Pharmacy fills the prescription since it was obvious the physician made a simple mistake ◦ When audited, they were cited with the reason “quantity changed or altered” and forced to pay back the entire amount paid � Pharmacies are simply asking for a fair and uniform process
HB 882 / SB 596 – Fair Audits Action Needed � Contact your state legislators and ask for: ◦ Support ◦ Co-sponsorship ◦ A committee vote to be scheduled Goal: get out of committee as soon as possible and have it up for a full vote in the House
