HOMICIDE • Homicide- the killing of one human being by another. • It is

HOMICIDE • Homicide- the killing of one human being by another. • It is considered the most serious of all acts. • May be criminal or non-criminal.

Criminal Homicide • Murder- the most serious form of criminal homicide- is killing that

Criminal Homicide • Murder- the most serious form of criminal homicide- is killing that is done with malice. • Malice- having the intent to kill or seriously harm, or acting in an extremely reckless manner which shows a lack of regard for human life (ex. shooting into a crowd)

First-Degree Murder • Defined as a killing that is premeditated (thought before hand), deliberate,

First-Degree Murder • Defined as a killing that is premeditated (thought before hand), deliberate, and done with malice. • Courts have often found that premeditation and deliberation can occur very close to the time of the homicide.

Felony Murder • Any killing that takes place during the commission of certain felonies,

Felony Murder • Any killing that takes place during the commission of certain felonies, such as arson, rape, robbery, or burglary. • It is not necessary to prove intent to kill. Malice is presumed because the homicide occurred during a felony, even if the killing was accidental.

Second-Degree Murder • Killing that is done with malice, but without premeditation or deliberation.

Involuntary Manslaughter • Unintentional killing resulting from conduct so reckless that it causes extreme danger of death or bodily injury. • Example- killing that results from playing with a gun known to be loaded

Negligent Homicide • Causing of death through criminal negligence. • Negligence- is the failure

Negligent Homicide • Causing of death through criminal negligence. • Negligence- is the failure to exercise a reasonable or ordinary amount of care in a situation that causes harm to someone. • Most common form is vehicular homicide.
