STATEWIDE HUB PROGRAM Texas Government Code § 2161 establishes the Statewide Historically Underutilized Business (HUB) Program and authorizes the Comptroller of Public Accounts (CPA) to administer the HUB program and set the rules. The HUB Program is a component of the Statewide Procurement Division at the CPA Office. The program rules can be found at Texas Administrative Code, Title 34, Chapter 20, Subchapter D, Division 1, Sections § 20. 281 to § 20. 298 (34 TAC 20). The 2009 Disparity Study determined there were still disparate groups in the state’s procurement process and identified the disadvantaged owner groups and established the Statewide HUB procurement goals. 4

STATEWIDE HUB PROGRAM 34 TAC 20. 281 Policy and Purpose It is the policy of the comptroller is to encourage the use of HUBs in the state procurement process through race, ethnic, and gender-neutral means. The purpose of the HUB program is to promote full and equal business opportunities for all businesses in state procurement and contracting in efforts to remedy disparity in state procurement and contracting. This rules describes the minimum steps and requirements to be undertaken by state entities to attain the aspirational goals recommended in the Texas Disparity Study. 6
HUB CERTIFICATION – HUB Directory The disparate groups in the state’s procurement are identified as: Ø Asian American Ø Black American Ø Hispanic American Ø Native American Ø American Woman Ø Service-disabled Veteran (SDV) is defined by 38 U. S. C. § 101(2) and must include at least a 20% service disability as defined by 38 U. S. C. § 101(16). *See Definitions in 34 TAC 20. 282 7
HUB CERTIFICATION HUB qualifications require small business structures to be: at least 51% owned by qualified HUB applicant, the qualified owner(s) must maintain control of the day-to-day operations, applicant owner(s) must be residents of Texas, applicant owner(s) must be citizens of United States (except for the SDV), and the business must be PRIMARILY based in Texas. 8

HUB CERTIFICATION HUB Directory Listing – is free with an approved HUB Certification HUB Directory is the official listing of HUBs and profiles are official state documents verifying your certification. NIGP profile description – is included with your HUB Directory Listing but it is up to the HUB to establish the listing with the correct NIGP codes that best describe the products and/or services of the business. 10
HUB CERTIFICATION IS A MARKETING TOOL TO ASSIST YOUR SMALL BUSINESS SELL TO THE STATE. HUB Certification guarantees the small business is given a “good faith effort” opportunity to bid in state procurements. It is the responsibility of the HUB to market the small business to the state agencies and state universities. HUB CERTIFICATION TRANSITION The state HUB certification process is in TRANSITION from a manual process to an ONLINE SYSTEM. Currently, we are NOT accepting mail or hand delivered applications. BEGINNING JUNE 28, 2021 – the certification process will only be submitted through the online system. 12
HUB CERTIFICATION TRANSITION § The online system will have steps to complete before a completed application can be submitted. All supporting documents requested will be uploaded and included with the application submission. No application can be submitted before it is complete. The certification process will be streamlined and quicker. 13
MEMORANDUMS OF AGREEMENT Through the MOA between Statewide HUB Program and DFW MSDC: As a member of DFW MSDC, you may request DFW MSDC reviews your certification information to verify HUB Certification requirements are met, if you qualify. . . DFW MSDC will submit your certification file and you will receive a free state HUB certification. HUB Certification is valid so long as the business is certified with DFW MSDC. 14
STATEWIDE HUB PROGRAM TOOLS The HUB Directory is the state’s official list of certified HUBs.
