Thesis • Corporal punishment should be banned in all instances including spanking by parents, because this causes long lasting emotional and physical damage to children, it also perpetuates a pattern of behaviour that continues from one generation to the next period. Laws must be fully enacted to protect our children and entitle them to the same rights as citizens.

What is Corporal punishment and Spanking? • "Spanking" is defined as striking a child with an open hand on the buttocks or extremities in order to modify behavior with physical pain. "Corporal punishment, " on the other hand, has a bit broader of a definition. On top of traditional open-handed spanking, corporal punishment can include spanking with objects (like a hairbrush), as well as other aggressive behavior that falls short of actual abuse.

Law in Canada? • 43 of the criminal code gives parents the right to spank their children which is a form of corporal punishment. The supreme court of Canada ruled in 2004 that reasonable limits must be attached to section 43 such as children must be between the ages of 2 and 12, children can be disciplined with an object and hits to the head would be un acceptable • The criminal code concerning corporal punishment section 43 in particular has been challenged several times by provincial high courts and finally in 2003 the highest court in the country (Supreme Court in Canada) heard the case. The judicial body reserved their judgement until 2004 when they ruled. Minor physical punishment was acceptable and did not infringe on the individual rights of the children providing it was beneficial for the child.

In conclusion • Getting rid of sections 43 of the criminal code is a step in the right direction, but it does very little to change attitudes fostered over many years considering corporal punishments is used as a method to control child behaviour. Many people in our society don’t realize the accumulative damage done to children do to this abuse. In conclusion if Canada does not change their rights then children will still have to deal with the trauma of the spanking and then they will become the spankers and the cycle will never stop.
