Bagley-Keene Open Meeting Act and Public Records Act A Primer for the Lithium Valley Commission February 25, 2021 Deborah Dyer Senior Staff Counsel California Energy Commission
Bagley-Keene Purpose: • To ensure that public agencies conduct the people’s business openly so that the public may observe the body’s decision-making process and be informed • The public gets a “seat at the table“ with the ability to monitor and participate in the decision-making process 25

BK Application to Subcommittees BK also applies to advisory subcommittees, if created by formal action of the state body, and if the advisory subcommittee consists of three or more persons. 29

What is a Serial Meeting? A SERIAL MEETING is when a majority of the members use a series of communications of any kind, directly or through intermediaries, to discuss, deliberate, or take action on any item of business within the jurisdiction of the body. 31

Exceptions to Communication Limitation • Social or ceremonial situations • Conferences and retreats • Open and noticed meetings of other state or legislative body or local agencies • Conversations that do not relate to the state body’s jurisdiction 36
