ESSER III – American Rescue Plan Act of 2021 (ARP ESSER) • Nearly $122 billion to state and school districts to help safely reopen and sustain the safe operation of schools and address the impact of the coronavirus pandemic on the nation’s students. • • Purpose: Meet a wide range of needs arising from the coronavirus pandemic, including reopening schools safely, sustaining their safe operation, and addressing students’ social, emotional, mental health, and academic needs resulting from the pandemic. State Reserves: Specified percentages for specified activities. • Additionally, $3 billion for special education, $850 mill for outlying areas, and $2. 75 billion to support non-public schools, and additional funding for homeless children and youth, Tribal educational agencies, Native Hawaiians, and Alaska Natives. 7

But can only draw down 2/3 of LEA allocation until CDE receives the remainder of the funds. New Requirement under ARP ESSER/ESSER III • LEAs must develop and make publicly available a plan for safe return to in-person instruction • • An LEA that receives ARP ESSER funds must, within 30 days of receiving the funds, make publicly available on its website a plan for the safe return to in-person instruction and continuity of services. Before making the plan publicly available, the LEA must seek public comment on the plan. An assurance in the CDE ESSER III application, with a text box to include the link to where the plan will be posted and/or explanation of when and where the plan will be available. • SEAs and LEAs maintenance of equity requirements for FY 2022 and 2023.
