The Amendment Process
Affidavit to Amend a Record (VS 24) What is it used for?
Affidavit to Amend a Record (VS 24) Used for: Correcting spelling errors Adding information to blank/unknown items Correcting medical information Correcting most information on the birth, death or fetal death certificate
Affidavit to Amend a Record (VS 24) - continued Cannot be used to: Completely change a first, middle or last name on a birth certificate Transpose first and middle names Translate names to another language, e. g. , Juan to John, etc. Change or remove signatures Change informant or original certifier Change parentage
Affidavit to Amend a Record (VS 24) - continued Two persons with knowledge of the facts must sign the amendment If it’s a hospital error, hospital staff must sign the amendment form If correcting date, time, or place of event the physician or hospital must sign the amendment form
Affidavit to Amend a Record (VS 24) - continued No fee if filed within one year event date, with exception of gender errors After one year - $23 fee is required that includes a certified copy, extra copies are $25 Request must include the VS 24, fee, possible back-up documentation, and notarized sworn statement
Death Amendments Two types: - Affidavit to Amend a Record (VS 24) - Physician/Coroner’s Amendment (VS 24 A) (The VS 24 B is obsolete. )
Physician/Coroner’s Amendment (VS 24 A) What is it used for?
Physician/Coroner’s Amendment (VS 24 A) - continued Used to correct any information on the death certificate Only the physician/coroner may amend date, time, place, or cause of death Only requires one signature, but must be physician or coroner
Acknowledgement of Paternity (VS 22) What is it used for?
Acknowledgement of Paternity (VS 22) - continued Used to add the father/parent and/or SRDP’s name to the birth certificate, if the field contains dashes What does SRDP stand for? Also used to change the child’s surname to that of the father/parent’s
Acknowledgement of Paternity (VS 22) - continued Requires the signature of both parents If the parents are not married, a POP form is also required If the parents are married or in a SRDP, a copy of marriage license or state registered domestic partnership paper is required
Acknowledgement of Paternity (VS 22) - continued Request must include the VS 22, fee, POP form or marriage/SRDP paper, and notarized sworn statement Original record will be sealed and new certificate forwarded – why?
Adjudication of Facts of Parentage (VS 21) What is it used for?
Adjudication of Facts of Parentage (VS 21) - continued Used to change or remove parentage on the birth certificate Used to add father/parent’s name if both parents are not available to sign VS 22
Adjudication of Facts of Parentage (VS 21) - continued Request must include VS 21, fee, and certified copy of the court order Because we receive a court order – a notarized sworn statement is not necessary Original record will be sealed and new certificate forwarded – why?
Court Order Name Change (VS 23) What is it used for?
Court Order Name Change (VS 23) - continued Used to completely change the registrant’s name on the birth certificate Not used to change parents’ names Request must include the VS 23, fee, certified copy of court order with original seal VS 23 is attached to and becomes part of the original birth certificate
Correcting Gender Errors on Birth Certificates What does correcting gender errors on birth certificates mean?
Correcting Gender Errors on Birth Certificates If there is a true error in the gender, use the VS 24 to correct Request should include VS 24, notarized sworn statement, and fee Fee is required even if processed within first year
Correcting Gender Errors on Birth Certificates VS 24 should be signed by parent and hospital, local registrar, or doctor For births that are currently two pages, customers may request a new birth certificate be prepared Original record will be sealed and new certificate forwarded – why?
Gender Reassignment What does gender reassignment mean?
Gender Reassignment When a person has undergone clinically appropriate treatment for the purpose of gender transition They may submit an amendment to amend the birth certificate that includes the affidavit of a physician Person may also file a court order name change if necessary
Gender Reassignment Request must include the VS 24 to correct the gender Affidavit of physician and fee If the name has been changed, request should also include court order name change (VS 23) Original record will be sealed and new certificate forwarded – why?
Court Report of Adoption (VS 44) What is a Court Report of Adoption?
Court Report of Adoption (VS 44) - continued Upon receipt of VS 44 and STD 215 from court clerk, CDPH-VR will prepare a new birth certificate No fee required for in-state adoptions $20 fee required for out-of-state adoptions New birth certificate is prepared, however, new parents may request to keep original birth certificate on file as is
Court Report of Adoption (VS 44) - continued If the child was born out-of-state, the VS 44 should be forwarded to that state If child was born in another country we’ll prepare a court order delayed birth certificate Original record will be sealed and new certificate forwarded – why?

Delayed Registration of Birth (VS 85) What is a Delayed Registration of Birth?
Delayed Registration of Birth (VS 85) – continued Used when there is no registered birth certificate on file and the child is at least one year old Must be submitted by person if he/she is 18 years old or older at time of application
Delayed Registration of Birth (VS 85) - continued Two pieces of documentary evidence Or, one piece of documentary evidence with one affidavit signature by principal attendant Or, one piece of documentary evidence with two affidavit signatures by other persons

Court Ordered Delayed Registration of Death (VS 109) continued Used when the event is over one year old Used to register death if no remains are located, e. g. , plane crash, mass fatality

Multiple Parent Birth Certificate This VS 10 M is to allow more than two parents to be listed on a birth certificate Based on AB 1403 (Chapter 510, Statutes of 2013) and SB 274 (Chapter 564, Statutes of 2013) that allow a child to have more than two parents These will only be created by the State Registrar and upon receipt of a court order
