Brushy Bend Park Property Owners Association Annual Meeting 01/18/2018 2017 Annual Meeting Minutes 7: 10 Meeting was called to order by POA president Paul Lake. Current officers and board members introduced themselves. Secretary Beth Amundson read the minutes from the January 20, 2016, annual meeting. Minutes were approved. Newly elected Sheriff Robert Chody spoke briefly. He stated that Brushy Bend Park is a safe neighborhood. There have been very few calls to the sheriff’s office regarding serious crimes in the neighborhood. He advised residents to keep their homes and cars locked to prevent theft. Brushy Bend Park Property Owners Association Annual Meeting 01/18/2018 2017 Annual Meeting Minutes (Cont. ) 2016 – “Year at a Glance” 1) The LCRA transmission line - residents were encouraged to express their opinions about the line on the LCRA website 2) On-line memberships to the POA became available 3) The on-line Brushy Bend Park directory was updated 4) The Round Rock tool lending trailer was made available to residents in July 5) In June & July the entrances to the subdivision were cleaned up 6) The annual picnic was held at Chris Walsh’s ranch in June 7) There is now a Welcome Wagon page on the BBP website 8) A “stage 4” abatement letter was sent to a resident who has refused to comply with deed restrictions 9) The Halloween hayride was attended by about 100 kids on 5 trailers 10) On December 29, 2016, Aqua Texas took over administration of BBP’s water from Brushy Creek MUD http: //www. brushybendparkhoa. com
Brushy Bend Park Property Owners Association Annual Meeting 01/18/2018 2017 Annual Meeting Minutes (Cont. ) Paul Lake gave the treasurers report. There were 71 members in 2016. The POA had a net profit of $846 for 2016. Brian Wickman, Road Committee. The Creek Bend road extension and bridge are now open. The county has finalized plans for improving the bridge at Great Oaks Drive: it will be four lanes; at current grade, and have the ability to handle a traffic signal (in the future). The project is slated to begin mid-2017. Brent Reeh, Area Manager from Aqua Texas spoke about their purchase of BBP water assets. Our water supply will continue to come from the Brushy Creek MUD; in a couple of years our water will be sourced from the City of Round Rock. Brent advised all residents to make sure Aqua Texas has complete and current contact information. Mike Marka is the local field supervisor however, Brent encouraged residents to call the 877 Call Center number if they needed assistance. He then opened the floor to questions: a) will Aqua Texas install fire hydrants? No b) the call center is in Illinois c) boil water notices are required by TCEQ if water pressure goes below a certain point d) your 16 -digit account code will be on your first bill http: //www. brushybendparkhoa. com
Brushy Bend Park Property Owners Association Annual Meeting 01/18/2018 e) when our water comes from the city of Round Rock, there will be a city service charge added to our bill f) fire hydrants painted black means they are technically “out of service”. That designation is for the fire department’s information. Social Committee Paul Lake presented for Noel Green. The annual BBQ was great, several people brought their antique and special cars to show. About 60 people attended. Halloween Hay Ride was successful. Five trailers were not enough and more will be needed next year. Ladies Night Out. Becky Clowers said she would like to rotate meeting places and renew interest in the event. Several ladies said they had not received notices about the Night Out, a list was sent around to have your name added to the Evite list http: //www. brushybendparkhoa. com
Brushy Bend Park Property Owners Association Annual Meeting 01/18/2018 Community Affairs, Brian Wickman There are 31 proposed routes for the LCRA high voltage lines. Route 31 has been endorsed by the cities of Round Rock, Cedar Park and Leander. A judge will review the proposed routes and come back with a recommendation. The Park is a new retail area near Costco in Cedar Park and should be open by mid-2017 Nine homes sold in our neighborhood with an average selling price of $171/sq foot. http: //www. brushybendparkhoa. com
Brushy Bend Park Property Owners Association Annual Meeting 01/18/2018 Architectural Committee Jeff Fluegel. The committee is an oversight group. They reviewed 19 cases. There are currently 4 homes in violation. There is a five-man committee working on proposing amendments to the deed restrictions. They are working on several points and almost ready for lawyer review. Points include: a) updating fence material requirements b) defining what constitutes living space vs. storage space; not require both to fall under the same exterior requirements c) define the difference between an ‘animal’ and a ‘pet’ and update the number of each allowed on each property d) define ‘natural stone’, hardy plank is not a natural stone. Michael Huemmer stated that owner’s presentation to the ARC does not to need to be a formal document. He showed the flow chart of how the ARC works http: //www. brushybendparkhoa. com
Brushy Bend Park Property Owners Association Annual Meeting 01/18/2018 Membership Committee - Mark Verrico. There are 206 properties in BBP and only 70 members of the POA. He asked each member to speak to one non-member about joining the POA Communications - Pat Harvey-Slager. Pat encouraged everyone to sign up on “Next Door” website if they have not already. Neighborhood Assistance Committee - Becky Clowers. There is a new “Welcome Wagon” section on the POA website offering information about the Neighborhood Watch, general utilities information, neighborhood cleanup and Round Rock tool lending trailer information. Becky then gave a presentation on what Neighborhood Assistance Committee is all about. Noel Green, Social Committee and Mark Verrico, Membership Committee stepped down from their positions Melissa Smith was nominated for Social Committee Kristin Clardy was nominated for Membership Committee Mark Martin was nominated to join the Architectural Committee The three new nominees and remaining board members were unanimously voted in. Amended Deed Restriction Process Lack of deed restriction enforcement was the number one issue voiced by homeowners at the 2017 annual meeting The BBPPOA BOD reviewed recommendations and approved moving forward after revisions Proposal documents mailed to all property owners Deed restrictions will be reviewed to obtain homeowner input at the 2018 annual POA meeting Drafts of deed restrictions were started A committee was formed consisting of the Architectural Committee and several homeowners Further refinements made to the deed restrictions Deed restriction changes were driven using: � Architectural committee experience � Homeowner input � Other area subdivision deed restrictions � Legal guidance Revised deed restrictions will be mailed to property owners A special meeting will be called to obtain a formal vote by all property owners POA membership is not required to vote A majority of property owners must approve the amended deed restrictions to be approved Property owners will be encouraged to vote if not present at the meeting Approved deed restrictions, if passed, are filed with the county http: //www. brushybendparkhoa. com

Proposed Deed Restrictions Summary Paragraph B Buildings with living area. � A building constructed on the lot other than the main home is defined as one that contains living area that includes kitchen, bath and bedrooms normally associated with area designated to be occupied. � Provision added that defines the minimum and maximum size of the separate guest house, or servant quarters. The minimum is 600 Sq feet and the maximum is defined by the size of the main residence on the lot; 25% of the main lodge or home living area. � Eliminated the requirement that the buildings be attached by common wall or covered passageway. � Keeps the provision that the building be of the same construction and percentage masonry as the main home. � It is the intent to limit any homeowner creating a “mini-subdivision” on their property. Buildings without living area � Referred to as “out buildings” � They do not contain living area such as kitchen, bath and bedrooms and are not intended to be occupied � Requirement added that they be located on rear of property and not feature prominently from any road the property abuts. This would include both roads adjacent to a corner lot. Proposed Deed Restrictions Summary Paragraph C. This paragraph was extensively reworded by adding definition about corner lots and how a building is defined as well as fencing restrictions. Adds a restriction on the placement of a portable building. The intent is that no portable buildings/structures are placed in the front yard Makes the distinction between privacy fence and non-privacy fencing and where each can be located. Elaborates on acceptable fencing materials/stays and eliminates the restriction to “chain link only” forward of the front of the house. Grandfathers chain link fencing forward of the front of the house for any house having such at the time of the deed restriction update. Proposed Deed Restrictions Summary Paragraph F adds clarity to the 50% masonry requirement. Verbiage to exclude Stucco and cement board as qualifying materials that can be included in the 50% masonry requirement. The intent here is that any new building fits in with the homes already built. 100% stucco or Cement board will not fit in with the majority of homes in the neighborhood. Reiterates that buildings with living area must adhere to the 50% masonry requirement. There is a provision for an addition to the rear of the main house after the initial building is constructed. It allows for the entire structure to fall below the 50% masonry level if the rear of the house is not masonry. If the addition is viewable from a side road in the case of a corner lot, and the existing rear of the house is not masonry, the 50% masonry requirement may be waived by the ARC for the structure as a whole once the addition is complete. http: //www. brushybendparkhoa. com
Proposed Deed Restrictions Summary Paragraph G elaborates on the keeping of animals on the property. Keeps the restriction on hogs and adds variations to include young hogs or pigs et al. Defines “animals” as any animal with hooves. Does not apply to non-hooved animals such as chickens, dogs and cats. However, in no case are animals to become a nuisance to adjoining properties by smell, disruption, waste/manure runoff, or roaming. Eliminates verbiage pertinent to the original developer on recourse for keeping lot clean and orderly Moves the responsibility for pursuing corrective action from the ARC to the entire Board of Directors. http: //www. brushybendparkhoa. com
Proposed Deed Restrictions Summary Paragraph H describes keeping properties clean Adds unused vehicles being stored as not acceptable Adds clarification for where RV’s, boats and other non- commercial vehicles should be stored. Adds that commercial vehicles used as part of a business cannot be stored on the property. Added a clause that the ARC must approve any subdivision of any lot and the minimum lot size will be 1. 5 Acres Paragraph N cleaned up verbiage for establishing the ARC. Eliminated the specific names called out in the original deed restrictions. Establishes the Board Of Directors as the approval body for any variance to the deed restrictions. Eliminates the provision for moving easements. Paragraph O establishes requirements for the display of commercial signage. Potential Questions Can non-POA members vote on deed restrictions? Yes. A majority of property owners have to approve proposed DR’s Why do we have to specify hooved animals? Hooved animals represent what most homeowners desire to keep on their property. Many HOA’s ban all animals and make an exception for “pets”. By specifying hooved animals the restriction is more open Why do we have to be so specific on fencing? Most HOA’s are far more specific of fencing and govern the actual materials to maintain consistency. It was felt that our neighborhood already had many types of fencing and that as long as it looks good it should be ok. Why did you pick 1. 5 acres for the minimum lot size for future subdivisions? 1 acre is mandated by the county due to septic provisions. If sewer was to be put in by the county, there would be no minimum. Our water system will be taxed to support further subdivisions 1. 5 acres would maintain the look and feel of the neighborhood http: //www. brushybendparkhoa. com
