Key Issues Yn ddiweddar, mae Bwrdd Diogelu Plant Gogledd Cymru wedi trafod canfyddiadau’r Ymchwiliad Annibynnol i'r adroddiad Cam-drin Plant yn Rhywiol ar gam-drin Plant mewn Sefydliadau Cadw. Mae’r adroddiad yn archwilio’r dystiolaeth sy’n dangos nad yw plant sy’n cael eu cadw mewn Sefydliadau Troseddwyr Ifanc (YOIs) a Chanolfannau Hyfforddi Diogel (STCs) yn dal i fod yn ddiogel rhag cam-drin rhywiol The North Wales Safeguarding Children’s Board have recently discussed the findings from the Independent Inquiry into Child Sexual Abuse report on abuse of Children in Custodial Institutions. The report examines the evidence showing that children held in Young Offender Institutions (YOIs) and Secure Training Centres (STCs) are still not safe from sexual abuse

The numbers of children in youth custody has declined considerably since 2008 from over 3000 to the current population of about 900; however, the concern is that despite the drop in numbers of detained children the number of reported incidents of sexual abuse is higher than previously understood. Mae dadansoddiad yr Ymchwiliad yn datgelu fod 1, 070 o achosion honedig o gam-drin plant yn rhywiol rhwng 1 Ionawr 2009 a 31 Rhagfyr 2017. The Inquiry’s analysis reveals 1, 070 alleged incidents of child sexual abuse from 1 January 2009 to 31 December 2017.

Key Issues Mae trosiant staff, hyfforddiant annigonol a’r ffaith mai dim ond rhai o argymhellion yr adroddiadau archwilio ar YOIs a STCs sydd wedi eu cyflawni, yn awgrymu fod y gwasanaeth yn wynebu argyfwng tuag at ddiwedd cyfnod yr ymchwiliad. Gall diwylliant ‘caeedig’ mewn sefydliadau olygu fod camdriniaeth yn guddiedig, gan ei gwneud yn anoddach i ddioddefwyr ddianc rhag camdriniaeth. Staff turnover, inadequate training and few of the recommendations of inspection reports of YOIs and STCs have been achieved suggesting that the service was in crisis towards the end of the period of the investigation. A ‘closed’ culture in institutions can mean abuse is hidden making it more difficult for victims to escape the abuse.

Barriers to disclosure in custody include: the context of violence, power imbalance between staff and children, children not being believed and children’s distrust of authority. 5. Materion Allweddol 5. Key Issues Systemau a Gweithdrefnau Systems and Procedures Mewn YOIs ac STCs, yn anaml y cyfeiriwyd cyhuddiadau o gam-drin plant rhywiol at yr heddlu neu’r awdurdod lleol. In YOIs and STCs allegations of child sexual abuse were rarely referred to the police or the local authority. 6. Argymhellion Bydd yr Adran Addysg a’r gwasanaeth Dalfeydd Ieuenctid yn adolygu a yw gosod plant gyda’i gilydd am resymau cyfiawnder a lles mewn SCHs yn cynyddu’r perygl y bydd plant yn cael eu cam-drin yn rhywiol, a bydd cynllun gweithredu yn cael ei gyhoeddi ymhen 6 mis. Bydd y Gwasanaeth Dalfeydd Ieuenctid yn sicrhau hyfforddiant diogelu priodol ar gyfer staff yng nghyd-destun yr ystâd ddiogeled gydag adolygiadau a diweddariadau rheolaidd. Mae’r Weinyddiaeth Gyfiawnder yn cyflwyno trefniadau ar gyfer cofrestru staff proffesiynol mewn swyddi sy’n gyfrifol am ofal plant mewn YOIs ac STCs. 6. Recommendations The Df. E and Youth Custody service to review whether placing children together for justice and welfare reasons in SCHs increases the risk of sexual abuse to children, and an action plan to be published within 6 months. Youth Custody Service to ensure appropriate safeguarding training for staff in the context of the secure estate with regular reviews and updates. The Ministry of Justice introduces arrangements for the professional registration of staff in roles responsible for the care of children in YOIs and STCs.

7. Argymhellion Mae’r Weinyddiaeth Gyfiawnder yn adolygu ac yn cyhoeddi cyfarwyddiadau sydd wedi dyddio ar hyn o bryd ar gyfer ‘cynnal amgylchedd saff a diogel’ i roi arweiniad ar sut i ymateb i honiadau o gam-drin plant yn rhywiol, gan gynnwys cyfeirio pob honiad at weithiwr proffesiynol amddiffyn plant annibynnol. Dylai pob sefydliad gyhoeddi eu polisïau diogelu eu hunain i gynorthwyo craffu. 7. Recommendations The Ministry of Justice revises and publishes current out of date instructions for ‘maintaining a safe and secure environment’ to give guidance on how to respond to allegations of child sexual abuse, to include allegations are referred to an independent child protection professional. All institutions should publish their safeguarding policies to aid scrutiny.
