4 Purpose • Award of annual term contract for “Transport, Processing and Disposal of Biosolids from the Eastern and Northwestern Water Reclamation Facilities”

6 Background • Biosolids - Primarily organic solid product produced by wastewater treatment processes that can be beneficially recycled and meets US Federal criteria for beneficial reuse - Orange County’s 3 regional facilities produce a total of approximately 100, 000 tons of biosolids per year or 262 tons per day
7 Background –Timeline • • 12/1/06 - Shelley’s begin operations under most recent annual term contract 10/14/10 – DEP issued “Notice of Permit Denial” 11/30/10 – Shelley’s contract expired and was not renewed 12/1/10 – N-Viro began providing biosolids services under emergency contract 12/22/10 – IFB issued for new annual contract 12/30/10 – Shelley’s agreed to a “Consent Final Judgment” with the FDEP and received a new 5 -year permit 1/11/11 – BCC ratified emergency contract to N-Viro

10 Current Issue • • • Shelley’s is the low bid by $494, 000 annually DEP has agreed to issue Shelley’s a new 5 -year permit Conditions of the new permit: - 3 rd party oversight Quarterly reporting Transfer of operations to new operator
