BILL OF RIGHTS HIGHLIGHTS n n n 1 ST AMENDMENT: Freedom of Speech, Press, Assembly, Religeon, and Petition 4 th AMENDMENT: Right against illegal search and seizure (your home is your castle) 5 th AMENDMENT: Right against self incrimination, can’t be tried for the same thing twice, due process (rules followed) 6 th AMENDMENT: A speedy trial, impartial jury, informed of charges against you, can confront a witness. 8 th AMENDMENT: No cruel and unusual punishment
CONSTITUTIONALITY FACTORS FOUR WAYS THE SUPREME COURT DETERMINES WHETHER SOMETHING IS CONSTITUTIONAL
TIME, SPACE, AND MANNER n Does the activity or event interfere with the ability of citizens to access a place or service where have a Constitutional right to be? n n Example: You want to protest the price of stamps by chaining yourself to the doors of the Yelm Post office. This is illegal because you are keeping others from sending or receiving mail which is protected by law. Example: You don’t like Mr. Price’s teaching and decide to block the doors to his room. Blocking access to a classroom to others who want to be there is illegal. Getting a permit and having a “Mr. Price is a Rotten Teacher” parade would be allowed.
PUBLIC GOOD AND SAFETY n Would your actions create an obvious danger to others. n n Example: Carrying a loaded weapon or a knife onto an airplane or into a courthouse Example: The legislature passing a law requiring a concealed weapons permit to anyone who want’s to carry a gun.
AGE OF CONSENT AND RESPONSIBILITY n The people legally allowed to engage in the activity are old enough to be aware of it’s responsibilities and consequences. n n Example: 9 year olds can not drive automobiles. Society does not deem them responsible or capable of such a task. You may join the Military or vote for an elected official before you are 18. This is to prevent Avril Lavigne or 50 Cent from becoming a congress person (kidding… sort of).
EXCEPTIONAL STANDARDS n The activity or requirement is one that would be considered normal or acceptable in other regions of the country. Example: If you are allowed to watch PG movies at school in Washington, it is reasonable to assume that you can watch them in school if you move to Alabama. n Example: You can only legally marry one person in Washington and the same law applies in all other states. n
