Obligaciones del Exportador • Proporcionar copia de la certificación de origen a la Parte exportadora. • Notificar la expedición de una certificación de origen que ha sido expedida incorrectamente a quien el exportador o productor la haya proporcionado. • Conservar los registros que fundamentan el origen de la mercancía por 5 años. www. gray-robinson. com 29
Conservacion de los registros Exportador debe mantener los registros relativos a: – la adquisición, los costos, el valor de, y el pago de la mercancía exportada; – la adquisición, los costos, el valor y el pago de todos los materiales, incluyendo materiales indirectos, utilizados en la producción del bien exportado, y – la producción de la mercancía en la forma en que se exportó. www. gray-robinson. com 30
Verificación La Parte importadora podrá conducir una verificación, mediante: 1. solicitudes escritas de información al importador, exportador o productor; 2. cuestionarios escritos dirigidos al importador, exportador o productor; o 3. visitas a las instalaciones de un exportador o productor en el territorio de la otra Parte, con el propósito de examinar los registros o inspeccionar las instalaciones utilizadas en la producción de la mercancía www. gray-robinson. com 31
Sanciones No se imponen sanciones si el importador: – no incurrió en negligencia, negligencia grave o fraude, al realizar la solicitud y paga cualquier arancel aduanero adeudado, o – al darse cuenta de que tal afirmación no es válida, rápida y voluntariamente corrige la solicitud y paga cualquier arancel aduanero adeudado. www. gray-robinson. com 32

Export Licenses • BIS is responsible for regulating the export of most commercial items, often referred to as “dual-use” items which are those having both commercial and military or proliferation applications. • If a product is a dual-use item an export license will need to be obtained. www. gray-robinson. com 36
Export Licenses • The license requirements are dependent upon an item's technical characteristics, the destination, the end-use, and the end-user, and other activities of the end-user. • You first need to verify whether your product requires a special export license by checking to see if it has an Export Control Classification Numner (ECCN) listed on the Commerce Control List (CCL) www. gray-robinson. com 37

FDA Entry Reviewers • FDA has trained individuals who review entry declarations and evaluate the admissibility of a product. • Entry reviewers have several options: – Release the product – Request examination of the product – Request additional information or documents – Recommend detention of the product www. gray-robinson. com 41

Removal from Import Alert List • FDA’s Regulatory Procedures Manual provides guidance to those who wish to get off the Import Alert list: • Generally, one would need: – A minimum of five consecutive non-violative commercial shipments must enter the U. S. , – At least one of the five non-violative entries should be audited by the FDA to ensure compliance, – The five shipments must be over a reasonable time period, not one day – A Petition must be filed with the FDA requesting that the importer be removed from the automatic detention list www. gray-robinson. com 45
