AFCARS ICWA ACTIVE EFFORTS INTRO The Social Security Act requires that the Administration for Children and Families (ACF) regulate a national data collection system that provides comprehensive demographic and case-specific information on children who are in foster care and adopted. This final rule replaces existing Adoption and Foster Care Analysis and Reporting System (AFCARS) regulations and the appendices that require title IV–E agencies to collect and report data to ACF on children in out-of-home care, and who exit out-of-home care to adoption or legal guardianship, children in out-of-home care who are covered by the Indian Child Welfare Act (ICWA), and children who are covered by a title IV–E adoption or guardianship assistance agreement. Active efforts are required to prevent the breakup of an Indian family by preventing an out-of-home placement or by fostering reunification when the child is removed from the physical or legal custody of his or her parents. These efforts must take into account the prevailing social and cultural conditions and the way of life of the Indian child's tribe. They shall also involve and use the available resources of the extended family, the tribe, Indian social services agencies, and individual Indian care givers. It is the agency’s responsibility to ensure that active efforts provided to the Indian family are rigorous, continuous, and documented for the quarter reporting period.
