Principle of Community The life and work of a Dartmouth student should be based on integrity, responsibility, and consideration. In all activities each student is expected to be sensitive to and respectful of the rights and interests of others and to be personally honest. He or she should be appreciative of the diversity of the community as providing an opportunity for learning and moral growth.

Freedom of Expression & Dissent Freedom of expression and dissent is protected by College regulations. Dartmouth College prizes and defends the right of free speech and the freedom of the individual to make his or her own disclosures, while at the same time recognizing that such freedom exists in the context of the law and in responsibility for one’s own actions. The exercise of these rights must not deny the same rights to any other individual. The College therefore both fosters and protects the rights of individuals to express dissent.
Academic Honor Principle • Fundamental to the principle of independent learning are the requirements of honesty and integrity in the performance of academic assignments, both in and out of the classroom. Dartmouth operates on the principle of academic honor, without proctoring of examinations…… • The Academic Honor Principle depends on the willingness of students, individually and collectively, to maintain and perpetuate standards of academic honesty. Each Dartmouth student accepts the responsibility to be honorable in the student's own academic affairs, as well as to support the Principle as it applies to others.

Objectives • Share the role and purpose of Title IX and the office • Learn about resources and support and how to access them • Recognize that we all play a role in creating a respectful and inclusive community
What is Title IX? “No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance. ”
Why do we have a Title IX Office? • Because all members of our community: • Should feel safe and secure in their learning, living, and working environment so that they can fully participate in all of the opportunities Dartmouth provides • Are assured of a fair process to resolve complaints
What does this mean? The College has a duty to respond promptly to incidents of sexual and gender-based harassment, sexual assault, relationship and interpersonal violence, stalking, and retaliation in a way that: 1. eliminates the harm; 2. prevents its reoccurrence; and 3. addresses its effects.

Consent • Consent is an affirmative and willing agreement to engage in specific forms of sexual contact with another person. Consent requires an outward demonstration, through mutually understandable words or actions, indicating that an individual has freely chosen to engage in sexual contact. • Consent cannot be obtained through: 1. the use of coercion or force; or 2. by taking advantage of the incapacitation of another individual. • Silence, passivity, or the absence of resistance does not imply consent. • Consent can be withdrawn by either person at any point.
Retaliation Prohibited • Federal and state laws and College policy prohibit retaliation • Cannot retaliate against someone for bringing or supporting a complaint • Complaint only needs to be brought in good faith • No retaliation even if no unlawful harassment found
Campus Resources Confidential Private People who may not share your information without your express written consent • People who are required to promptly share a disclosure of Prohibited Conduct with the Title IX Office. § unless there is threat of imminent danger or required by law.
Dartmouth Confidential Resources • Dick’s House Health Services- all staff are confidential -Counseling -Inpatient Department -Primary Care -Athletic Trainers • Ordained clergy, or those considered licensed pastoral counselors at the Tucker Center -All other staff at the Tucker Center are PRIVATE resources • WISE (including the Campus Advocate, on campus Mondays in 37 Dewey, Room 452)
Dartmouth Private Resources • Also known as “responsible employees” • Required to promptly share a disclosure, including all known details and identifying information, with the Title IX Coordinator. • Disclosures will be shared only with individuals on a need-toknow basis or as required by law. • Private resources include the Title IX Coordinators, faculty, coaches, undergraduate deans, residential life staff, and all other individuals not designated as Confidential.
Title IX Office Response • Email contact with Reporting Person -Email sent within 24 hours of notice to Title IX Office -Ongoing outreach by Title IX Office • Notify of: -confidential and private resources, on- and off-campus; -right to contact law enforcement and seek medical treatment; -importance of preservation of evidence • Inform that it is voluntary and not obligatory to respond to or meet with a Title IX Coordinator • Invite reporting party to meet with a Title IX Coordinator at a time that works for them
What can you expect from the Title IX Office? ü Let parties choose what to talk about ü Actively connect all parties with resources and support policies and procedures ü Be clear that there are choices ü Respect all decisions ü Point out strengths and capacities ü Share information about resources and support ü Explain options and relevant policies and procedures
Interim Measures the Title IX Office Can Offer • • • Informal no contact directive Formal no contact order Classroom and registration measures Academic measures Housing adjustments Formal investigation
Report to Law Enforcement • Reporting Person determines whether to report to law enforcement • Hanover Police participates in the “You Have Options” program, which allows a reporting party to talk with law enforcement at length before deciding next steps • Involvement from law enforcement does not relieve the institution from investigating under Title IX • The College may find a policy violation under Title IX without a criminal sentence (evidentiary bar is different) -Preponderance of the evidence (College) -Beyond a reasonable doubt (Criminal)
As a member of the Dartmouth Community, we want you to know… • Everyone has a role to play in the intervention and prevention of sexual/gender-based harassment or violence. • Everyone is expected to create a respectful environment free from harassment. • Everyone is expected to be an active bystander, intervening before, during, or after any form of harassment. • Everyone is expected to assist and support individuals who have been harassed.
