“Ban the Box” Laws • Laws requiring removal of criminal history questions from employment applications and/or interviews. Generally prohibit employers from inquiring into an applicant’s criminal history until after a first interview or conditional offer of employment is made. • While most of these laws apply only to state and local governments, the laws in seven of these states (Hawaii, Illinois, Massachusetts, Minnesota, New Mexico, Oregon, and Rhode Island) apply to private employers as well. (Many cities and counties have also enacted some form of “Ban the Box” legislation for private employers, including Philadelphia, San Francisco, and Seattle).
