Consultation and co-creation with indigenous peoples Indigenous peoples in Canada is 1, 673, 785 people (2016) or 4. 9% of the national population: • 977, 230 First Nations people • 587, 545 Métis • 65, 025 Inuit Indigenous peoples of Québec is app. 105, 00 people (2015) or approximately 1, 5% of the population of Québec • 11 distinct ethnic groups: 10 First Nations communities and 1 Inuit community • App. one in ten indigenous person in Canada live in Quebec
UN Declaration of the Rights of Indigenous Peoples (UNDRIP) ■ Adoption at the UN on September 13, 2017 - 144 states in favour, 4 votes against (Australia, Canada, New Zealand the United States) and 11 abstentions. ■ Canada announced unqualified support for UNDRIP on May 10, 2016 ■ Specific mention of “Free, Prior and Informed Consent “(FPIC) as a pre-requisite for any activity that affects their ancestral lands, territories and natural resources. ■ FPIC as a fundament for “a new intervention model” and contemporary consultation channels? ■ Development of a a culture of democratic dialogue, of full information, transparency in managing affairs and co-creation.
”Free, Prior and Informed Consent” (FPIC) ■ All elements within FPIC are interlinked: 1. Prior: consent should be sought before any project, plan or action takes place 2. Free: consent it should be independently decided upon 3. Informed: consent should be based on accurate, timely and sufficient information provided in a culturally appropriate way § Why? For it to be considered a valid result or outcome of a collective decision making process.
Example: EU Seal Products Trade Ban ■ Ban on trade on seal fur products in the European Union adopted in 2009 ■ Logic behind legislation is ”…the field of ethics” (animal welfare) ■ Justified in two articles in the Treaty of the European Union’s: 1) Art. 95: the functioning of the internal market 2) Art. 133: common commercial policy, imports and exports § COWI study’s public consultation: Ø Conducted on EU Commission’s Interactive Policy Making Tool (IPM) Ø Conducted on the Internet in Dec. 20 2007 – Feb. 13 2008 Ø Responses: 73, 153 from 160 countries 87. 4 % did not consider seal hunting as justified. Consultation and co-creation I Contemporary consultation and co-creation has three steps – or colors Green § Aspect of change has a cognitive starting point § The logic sense of how we administer change – e. g. planning, scheduling, steering, control, management. § The bureaucrat’s role is that of a coordinator.
Consultation and co-creation II Blue Red ■ Blue aspect of change has a psychological-dynamic starting point. ■ Red aspect of change has an experiemental starting point. ■ The emotional sense of how we approach change – e. g. dialogue on complexity, historical heritage, group processes, feelings and emotions. ■ The bureaucrat’s role is that of the supporting and opening facilitator. ■ The ethic and social sense of how we approach change – e. g. dialogue on co-creation and on the creation of new policies, approaches, strategies, behavior. ■ The bureaucrat’s role is that of the experimental facilitator providing a room for the result.
