30 CFR Part 50. 10 Immediately Reportable Accidents and Injuries

Immediately Reportable There are certain types of serious accidents and injuries that you are to IMMEDIATELY report to MSHA. According to MSHA, these accidents or injuries are to be reported to them within 15 minutes.

IMMEDIATE NOTIFICATION Immediately Reportable Accidents and Injuries are to be reported within fifteen (15) minutes of awareness.

Section 103(j) of the ACT …. , the notification required shall be provided by the operator within 15 minutes of the time at which the operator realized that the death of an individual at the mine, or an injury or entrapment of an individual at the mine which has a reasonable potential to cause death, has occurred.

30 CFR Part 50. 10 The operator shall immediately contact MSHA at once without delay and within 15 minutes at the toll-free number, 1 -800 -746 -1553 once the operator knows or should know that an accident has occurred.

IMMEDIATELY REPORTABLE ACCIDENTS AND INJURIES INCLUDE: 1. 2. 3. A death of an individual at a mine. An injury to an individual at a mine which has a reasonable potential to cause death. An entrapment of an individual for more than 30 minutes.

Immediately Reportable Accidents 4. Unplanned inundation of a mine by gas or dust. 5. Unplanned ignition or explosion of gas or dust. 6. Unplanned mine fire not extinguished within 30 minutes of discovery.

Immediately Reportable Accidents 7. Unplanned ignition or explosion of a blasting agent or an explosive. 8. Unplanned roof fall or rib fall (UG) 9. Coal or rock outburst that causes withdrawal of miners or which disrupts regular mining activity for more than one hour.

Immediately Reportable Accidents 10. An unstable condition at an impoundment, refuse pile, or culm bank which requires emergency action in order to prevent failure, or which causes individuals to evacuate an area; or, failure of an impoundment, refuse pile, or culm bank.

Immediately Reportable Accidents 11. Damage to UG hoisting equipment in a shaft or stope… 12. An event at a mine which causes death or bodily injury to an individual not at a mine at the time the event occurs.

Citations Failure to follow these guidelines for immediately reporting accidents and injuries can result in serious citations.

Penalty The operator who fails to provide timely notification as required, shall be assessed a civil penalty of not less than $5, 000 and not more than $60, 000.

Call Anyway There have been instances where operators were unsure whether or not they should call. In some of those instances they called anyway to only find out that it wasn’t necessary. It is not against the law to call.

Emergency Response Plans Mine operators are advised to review their mine’s emergency response plan and to revise as necessary to accommodate this new MSHA requirement, which should include making sure those who would be responsible for making the call know to do so.
