Prohibited from Performing Safety-Sensitive Functions Is recorded as prohibited from performing safety-sensitive functions per 382. 501(a) in the Drug and Alcohol Clearinghouse. (390. 3(e)) Declare driver out of service until prohibition is removed from the Drug and Alcohol Clearinghouse. NOTE: Not applicable when operating outside the U. S. Safety-sensitive functions include operation of a commercial motor vehicle defined in 390. 5 and operated in interstate or intrastate commerce.

S. - Edit *FOOTNOTES 11 -14 NOTE: Property-carrying commercial motor vehicle drivers are placed out of service for 10 hours and passenger-carrying commercial motor vehicle drivers for eight hours. Violations are recorded on a roadside inspection report and the driver may be cited for failing to have a required electronic record of duty status. After eight hours (passenger-carrying drivers) or 10 hours (property-carrying drivers) out of service, the driver may continue to the final destination provided the driver has accurately documented his/her hours-of-service requirements using a paper record of duty status and has a copy of the inspection report and/or citation (the driver can pick up additional cargo if it is on the way to the final destination). If the driver is stopped again before reaching the final destination, the driver must provide the safety official with a copy of the inspection report and evidence (e. g. , bill of lading) to prove that he/she is still on the continuation of the original trip. The driver will be allowed to continue to the destination. After reaching the final destination, if the driver is re-dispatched without obtaining a compliant electronic logging device, he/she will again be subject to the out-of-service process outlined above, unless the driver is traveling back to the principal place of business or terminal empty (this includes pulling an empty trailer) to obtain an electronic logging device.

2019 -04 FMCSA Under-21 Military CDL Pilot Program English Spanish
2019 -04 FMCSA Under-21 Military CDL Pilot Program • Outlines the pilot program to allow 18 – 20 year old drivers to obtain a CDL • Drivers who have received specified heavy-vehicle driver training while in military • Outlines the standards for the motor carrier and the drivers to participate • Drivers are restricted from transporting passengers, hazardous materials and may not operate doubles, triples or cargo tanks.
2019 -04 FMCSA Under-21 Military CDL Pilot Program • Expecting about 75 motor carriers and at least 200 drivers to participate • Drivers will have an exemption letter to produce at the roadside • Provides guidance for inspectors to verify the motor carrier is participating in the program on Query Central • Shows the alerts that may appear and what actions to take if drivers or motor carriers are found with alerts or operating contrary to the program • Provides FMSCA contacts for further information
2020 -01 UCR Enforcement Bulletin • Bulletin was issued on Jan. 1, 2020 indicating enforcement of the Unified Carrier Registration (UCR) for 2020 is suspended until further notice. • The bulletin will be revised with the enforcement date when the 2020 fees are officially published in the Federal Register.
2020 -02 Roadside Examination of Drug and Alcohol Clearinghouse Status • As of Jan. 6, 2020, employers, or their designated representatives and medical review officers, are required to report information about drug and alcohol program violations to the clearinghouse. • Drivers in violation are not permitted to drive a commercial motor vehicle, until they have successfully completed the substance abuse professional (SAP) evaluation, referral and education treatment process and have a negative return-to-duty test.
2020 -02 Roadside Examination of Drug and Alcohol Clearinghouse Status • Roadside inspectors must verify a driver’s status based on the clearinghouse data. • Access Query Central (QC) at the driver level by entering the driver’s CDL information. QC will check the driver’s eligibility status and return the results in the box on the upper right of the screen. Drug and Alcohol Clearinghouse Status Driver is prohibited from operating under 49 CFR § 382. 501(1)(a)
2020 -02 Roadside Examination of Drug and Alcohol Clearinghouse Status • Access the Commercial Driver's License Information System (CDLIS) gateway (cdlis. dot. gov) at the driver level. The inspector will enter the driver’s CDL information and the results will reflect the driver’s eligibility status under the history search results at the top of the screen. 2020 -02 Roadside Examination of Drug and Alcohol Clearinghouse Status • A driver in a prohibited status should be cited for a violation of 49 CFR Part 390. 3 – Prohibited from performing safety-sensitive functions per 382. 501(a) in the Drug and Alcohol Clearinghouse. • Prior to April 1, 2020, a driver found operating in a prohibited status, should be cited a violation under 49 CFR Part 390. 3 and a copy of the inspection report should be forwarded to the local FMCSA office for follow -up action. • On and after April 1, 2020, this violation will be an out-of -service condition in the Commercial Motor Vehicle Safety Alliance North American Standard Out-of-Service Criteria and the driver will be placed out of service if found in a prohibited status.
