Notes from the County on Islands of Unincorporated Area: (See Exhibit 15 for full correspondence) - - - Nearly every city in Clackamas County has these enclaves within the outer areas of their UGB. Enclaves created by this proposal are not engaged in land uses that would be problematic for adjacent development. Streets can be planned to assume the enclaves will eventually incorporate and develop. - - - The City and County coordinate when property fronts a street under the other agency’s jurisdiction. Not aware of issues with enclaved parts of the County w/in City limits creating jurisdictional problems for roads or utilities. The City has created several enclaves in the past without major concerns.

Notes from HLA & FHCO on Statewide Housing Goal: Exhibit 16 is a letter from HLA (Housing Land Advocates) and FHCO (Fair Housing Council of Oregon) calling for the City to reference its HNA (housing needs analysis) on any land use decision related to residential land supply. - - Estacada’s last housing needs analysis was done in 1979, projecting to 2000. Estacada participated in Clackamas County’s Regional Housing Needs Analysis and received a baseline assessment of housing needs (2019 Housing Memo). The 2019 Housing Memo is a preliminary housing needs assessment, not an HNA. It serves as a starting point for the City to complete its own HNA.

Statewide Planning Goal 10: Housing Previous staff reports for Estacada annexations have not included Goal 10 findings, but future staff reports on residential annexations can include deeper findings related to the 2019 Housing Memo until we have a full HNA to lean on. Ultimately, the City needs to complete a full, Estacada-specific Housing Needs Analysis. This will not only bring us into compliance with Goal 10 but also help us ensure an adequate supply residential lands needed for the next 20 years. Technical assistance grants are available from the State on a biennial cycle. The City could apply in 2021.

Conditions of approval for annexation of PROPERTY 1) The annexation shall include the 161. 03 -acre area described as Township 3 South, Range 4 East, Section 17, Tax Lots 200, 300, 700, 900, 2000, and 2100; and Township 3 South, Range 4 East, Section 17 D, Tax Lots 201, 300, 1600, 1900, and 1901 in the Clackamas County tax map. 2) Upon annexation, the property shall be zoned as designated in the Estacada Comprehensive Plan Map. 3) The City’s Comprehensive Plan Map and official zoning map shall be amended to reflect the annexation and zone change. 4) The property owners shall sign a waiver of remonstrance against the dedication of right-of-way and other road and sidewalk improvements that are made consistent with City standards and necessary to serve future development on the property. *** If not all properties are approved for annexation, Condition #1 can be changed to exclude those properties which are not approved and include those that are. ***

Conditions of approval for annexation of ROADWAY 1) The annexation shall include all yet unincorporated portions of the SE Eagle Creek Road, SE Duus Road, and SE Cemetery Road that are within the UGB. 2) The annexation shall not be effective until Clackamas County has agreed to the annexation in a signed petition or other official statement. 3) The annexation shall not be effective until the City provides any County- or State- required legal description of the subject road sections, with an illustration depicting the description, stamped by an engineer or surveyor licensed in the State of Oregon, or any County- or Staterequired boundary survey of the road section completed by an engineer. 4) Upon annexation, the area of the property shall be zoned consistent with the City’s Comprehensive Plan designation. 5) The City’s Comprehensive Plan Map and official zoning map shapp be amended to reflect the annexation and zone change.
